8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 264.101(a), Family Code, is amended to | |
10 | 10 | read as follows: | |
11 | 11 | (a) The department shall [may] pay the cost of foster care | |
12 | 12 | for a child: | |
13 | 13 | (1) for whom the department [has initiated a suit and] | |
14 | 14 | has been named managing conservator under an order rendered under | |
15 | 15 | this title, who is a resident of the state, and who has been placed | |
16 | 16 | [by the department] in a foster home or child-care institution, as | |
17 | 17 | defined by Chapter 42, Human Resources Code; or | |
18 | 18 | (2) who is under the placement and care of a state | |
19 | 19 | agency or political subdivision with which the department has | |
20 | 20 | entered into an agreement to reimburse the cost of care and | |
21 | 21 | supervision of the child. | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2015. |
