| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 42.153(b), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (b) Funds allocated under this section may [, other than an |
|---|
| 13 | 13 | | indirect cost allotment established under State Board of Education |
|---|
| 14 | 14 | | rule, must] be used for any purpose authorized by Section 45.105 [in |
|---|
| 15 | 15 | | providing bilingual education or special language programs under |
|---|
| 16 | 16 | | Subchapter B, Chapter 29, and must be accounted for under existing |
|---|
| 17 | 17 | | agency reporting and auditing procedures]. |

| 18 | 18 | | SECTION 2. Section 42.1541(a), Education Code, is amended |
|---|
| 19 | 19 | | to read as follows: |
|---|
| 20 | 20 | | (a) The State Board of Education shall by rule increase the |
|---|
| 21 | 21 | | indirect cost allotments established under Sections 42.151(h), |
|---|
| 22 | 22 | | 42.152(c), [42.153(b),] and 42.154(c) [42.154(a-1) and (c)] and in |
|---|
| 23 | 23 | | effect for the 2010-2011 school year in proportion to the average |
|---|
| 24 | 24 | | percentage reduction in total state and local maintenance and |
|---|
| 25 | 25 | | operations revenue provided under this chapter for the 2011-2012 |
|---|
| 26 | 26 | | school year as a result of S.B. Nos. 1 and 2, Acts of the 82nd |
|---|
| 27 | 27 | | Legislature, 1st Called Session, 2011. |
|---|
| 28 | 28 | | SECTION 3. Section 42.153(c), Education Code, is repealed. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect September 1, 2015. |
