55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to permissible uses of the bilingual education allotment
88 provided under the foundation school program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.153(b), Education Code, is amended to
1111 read as follows:
1212 (b) Funds allocated under this section may [, other than an
1313 indirect cost allotment established under State Board of Education
1414 rule, must] be used for any purpose authorized by Section 45.105 [in
1515 providing bilingual education or special language programs under
1616 Subchapter B, Chapter 29, and must be accounted for under existing
1717 agency reporting and auditing procedures].
1818 SECTION 2. Section 42.1541(a), Education Code, is amended
1919 to read as follows:
2020 (a) The State Board of Education shall by rule increase the
2121 indirect cost allotments established under Sections 42.151(h),
2222 42.152(c), [42.153(b),] and 42.154(c) [42.154(a-1) and (c)] and in
2323 effect for the 2010-2011 school year in proportion to the average
2424 percentage reduction in total state and local maintenance and
2525 operations revenue provided under this chapter for the 2011-2012
2626 school year as a result of S.B. Nos. 1 and 2, Acts of the 82nd
2727 Legislature, 1st Called Session, 2011.
2828 SECTION 3. Section 42.153(c), Education Code, is repealed.
2929 SECTION 4. This Act takes effect September 1, 2015.
