11	5		relating to an intercollegiate athletics fee at Stephen F. Austin
12	6		State University; authorizing imposition of a fee.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. Subchapter E, Chapter 54, Education Code, is
15	9		amended by adding Section 54.5202 to read as follows:
16	10		Sec. 54.5202. INTERCOLLEGIATE ATHLETICS FEE; STEPHEN F.
17	11		AUSTIN STATE UNIVERSITY. (a) The board of regents of Stephen F.
18	12		Austin State University may charge each student enrolled at the
19	13		university an intercollegiate athletics fee in an initial amount
20	14		not to exceed $10 per semester credit hour for each semester or
21	15		summer session. The amount of the fee may be increased only as
22	16		provided by Subsection (f).
23	17		(b) The board of regents may prorate the amount of the fee
24	18		for a summer session.
25	19		(c) A student enrolled in more than 15 semester credit hours
26	20		shall pay the fee in an amount equal to the amount imposed on a
27	21		student enrolled in 15 semester credit hours during the same
28	22		semester or session.
29	23		(d) Revenue from the fee charged under this section may be
30	24		used only for financing, constructing, operating, maintaining, or
31	25		improving an athletic facility or for operating an intercollegiate
32	26		athletics program at the university.
33	27		(e) The fee may not be charged unless approved by a majority
34	28		vote of the students enrolled at the university who participate in a
35	29		general student election held for that purpose.
36	30		(f) The amount of the fee per semester credit hour may be
37	31		increased from one academic year to the next only if approved by a
38	32		majority vote of the students participating in a general student
39	33		election held for that purpose or, if the amount of the increase
40	34		does not exceed five percent, by a majority vote of the legislative
41	35		body of the student government of the university.
42	36		(g) The chief fiscal officer of the university shall collect
43	37		the fee and shall deposit the revenue from the fee in an account to
44	38		be known as the intercollegiate athletics fee account.
45	39		(h) A fee charged under this section is not considered in
46	40		determining the maximum amount of student services fees that may be
47	41		charged each student enrolled at the university under Section
48	42		54.503.
49	43		SECTION 2. This Act takes effect immediately if it receives
50	44		a vote of two-thirds of all the members elected to each house, as
51	45		provided by Section 39, Article III, Texas Constitution. If this
52	46		Act does not receive the vote necessary for immediate effect, this
53	47		Act takes effect September 1, 2015.
