55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the amount of certain controlled substances in the body
88 constituting intoxication for purposes of certain intoxication
99 offenses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 49.01(2), Penal Code, is amended to read
1212 as follows:
1313 (2) "Intoxicated" means:
1414 (A) not having the normal use of mental or
1515 physical faculties by reason of the introduction of alcohol, a
1616 controlled substance, a drug, a dangerous drug, a combination of
1717 two or more of those substances, or any other substance into the
1818 body; [or]
1919 (B) having an alcohol concentration of 0.08 or
2020 more; or
2121 (C) having present in the body any detectable
2222 amount of a controlled substance or a metabolite of a controlled
2323 substance listed in:
2424 (i) Penalty Group 1 under Section 481.102,
2525 Health and Safety Code;
2626 (ii) Penalty Group 1-A under Section
2727 481.1021, Health and Safety Code; or
2828 (iii) Penalty Group 2 under Section
2929 481.103, Health and Safety Code.
3030 SECTION 2. The change in law made by this Act applies only
3131 to an offense committed on or after the effective date of this Act.
3232 An offense committed before the effective date of this Act is
3333 governed by the law in effect on the date the offense was committed,
3434 and the former law is continued in effect for that purpose. For
3535 purposes of this section, an offense was committed before the
3636 effective date of this Act if any element of the offense occurred
3737 before that date.
3838 SECTION 3. This Act takes effect September 1, 2015.
