99 relating to the composition and terms of office of the Texas
1010 Alcoholic Beverage Commission.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 5.02(a), Alcoholic Beverage Code, is
1313 amended to read as follows:
1414 (a) The commission is composed of five [three] members, who
1515 are appointed by the governor with the advice and consent of the
1616 senate.
1717 SECTION 2. Section 5.03, Alcoholic Beverage Code, is
1818 amended to read as follows:
1919 Sec. 5.03. TERMS OF OFFICE. The members of the commission
2020 hold office for staggered terms of six years, with the term of one
2121 or two members, as applicable, [member] expiring every two years.
2222 Each member holds office until the member's [his] successor is
2323 appointed and has qualified. A member may be appointed to
2424 consecutive terms [succeed himself].
2525 SECTION 3. (a) Promptly after this Act takes effect, the
2626 governor shall appoint two additional members to the Texas
2727 Alcoholic Beverage Commission. In appointing those members, the
2828 governor shall appoint one person to a term expiring November 15,
2929 2019, and one person to a term expiring November 15, 2021.
3030 (b) Until all appointees have taken office, a quorum of the
3131 Texas Alcoholic Beverage Commission is a majority of the number of
3232 members who are qualified.
3333 SECTION 4. This Act takes effect September 1, 2015.
