77 relating to discrimination against an individual with a criminal
88 record by a life insurance company.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1101, Insurance Code, is amended by
1111 adding Subchapter E to read as follows:
1212 SUBCHAPTER E. PROHIBITED PRACTICES
1313 Sec. 1101.201. APPLICABILITY OF SUBCHAPTER. Unless
1414 otherwise provided by this subchapter, this subchapter applies to a
1515 life insurance policy:
1616 (1) issued or delivered in this state; or
1717 (2) issued by a life insurance company organized in
1818 this state.
1919 Sec. 1101.202. UNFAIR DISCRIMINATION. In addition to the
2020 requirements under Section 544.002, a life insurance company may
2121 not refuse to insure or provide coverage to an individual, refuse to
2222 continue to insure or provide coverage to an individual, limit the
2323 amount, extent, or kind of coverage available for an individual, or
2424 charge an individual a rate that is different from the rate charged
2525 to other individuals for the same coverage because of the
2626 individual's criminal record.
2727 SECTION 2. This Act takes effect September 1, 2015.
