| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 1101, Insurance Code, is amended by | |
| 11 | 11 | adding Subchapter E to read as follows: | |
| 12 | 12 | SUBCHAPTER E. PROHIBITED PRACTICES | |
| 13 | 13 | Sec. 1101.201. APPLICABILITY OF SUBCHAPTER. Unless | |
| 14 | 14 | otherwise provided by this subchapter, this subchapter applies to a | |
| 15 | 15 | life insurance policy: | |
| 16 | 16 | (1) issued or delivered in this state; or | |
| 17 | 17 | (2) issued by a life insurance company organized in | |
| 18 | 18 | this state. | |
| 19 | 19 | Sec. 1101.202. UNFAIR DISCRIMINATION. In addition to the | |
| 20 | 20 | requirements under Section 544.002, a life insurance company may | |
| 21 | 21 | not refuse to insure or provide coverage to an individual, refuse to | |
| 22 | 22 | continue to insure or provide coverage to an individual, limit the | |
| 23 | 23 | amount, extent, or kind of coverage available for an individual, or | |
| 24 | 24 | charge an individual a rate that is different from the rate charged | |
| 25 | 25 | to other individuals for the same coverage because of the | |
| 26 | 26 | individual's criminal record. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2015. |
