77 relating to the creation of a childhood health program grant.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 161, Health and Safety Code, is amended
1010 by adding Subchapter W to read as follows:
1111 SUBCHAPTER W. CHILDHOOD HEALTH PROGRAM GRANTS
1212 Sec. 161.651. DEFINITION. In this subchapter, "department"
1313 means the Department of State Health Services.
1414 Sec. 161.652. CHILDHOOD HEALTH PROGRAM GRANTS. (a) Subject
1515 to the availability of funds as described by Subsection (h), the
1616 department shall develop and implement a grant program to support
1717 programs related to childhood health, fitness, and obesity
1818 prevention.
1919 (b) The department shall request proposals for the award of
2020 a grant under the program. The department shall evaluate the
2121 proposals and award a grant based on a proposed program's
2222 quantifiable effectiveness and potentially positive impact on the
2323 health of children who participate in the program.
2424 (c) A grant awarded under this section must be made to an
2525 organization that has committed resources to the program described
2626 in the proposal.
2727 (d) A grant recipient may use grant money received under
2828 this section only to pay for activities directly related to the
2929 purpose of the grant program as described by Subsection (a) and may
3030 not use grant money for fees or advertising.
3131 (e) The department shall establish procedures to administer
3232 the grant program, including a procedure for the submission of a
3333 proposal and a procedure to be used by the department to evaluate a
3434 proposal.
3535 (f) The department shall enter into a contract that includes
3636 performance requirements with each grant recipient. The
3737 department shall monitor and enforce the terms of the
3838 contract. The contract must authorize the department to recoup
3939 grant money from a grant recipient for failure of the grant
4040 recipient to comply with the terms of the contract.
4141 (g) The legislature may not appropriate money, other than
4242 money described by Subsection (h), for the purpose of awarding
4343 grants under this section.
4444 (h) The department may solicit and accept gifts, grants, and
4545 donations from any public or private source to implement this
4646 subchapter.
4747 SECTION 2. This Act takes effect September 1, 2015.
