| 7 | 7 | | relating to the creation of a childhood health program grant. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 161, Health and Safety Code, is amended |
|---|
| 10 | 10 | | by adding Subchapter W to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER W. CHILDHOOD HEALTH PROGRAM GRANTS |
|---|
| 12 | 12 | | Sec. 161.651. DEFINITION. In this subchapter, "department" |
|---|
| 13 | 13 | | means the Department of State Health Services. |
|---|
| 14 | 14 | | Sec. 161.652. CHILDHOOD HEALTH PROGRAM GRANTS. (a) Subject |
|---|
| 15 | 15 | | to the availability of funds as described by Subsection (h), the |
|---|
| 16 | 16 | | department shall develop and implement a grant program to support |
|---|
| 17 | 17 | | programs related to childhood health, fitness, and obesity |
|---|
| 18 | 18 | | prevention. |
|---|
| 19 | 19 | | (b) The department shall request proposals for the award of |
|---|
| 20 | 20 | | a grant under the program. The department shall evaluate the |
|---|
| 21 | 21 | | proposals and award a grant based on a proposed program's |
|---|
| 22 | 22 | | quantifiable effectiveness and potentially positive impact on the |
|---|
| 23 | 23 | | health of children who participate in the program. |
|---|
| 24 | 24 | | (c) A grant awarded under this section must be made to an |
|---|
| 25 | 25 | | organization that has committed resources to the program described |
|---|
| 26 | 26 | | in the proposal. |
|---|
| 27 | 27 | | (d) A grant recipient may use grant money received under |
|---|
| 28 | 28 | | this section only to pay for activities directly related to the |
|---|
| 29 | 29 | | purpose of the grant program as described by Subsection (a) and may |
|---|
| 30 | 30 | | not use grant money for fees or advertising. |
|---|
| 31 | 31 | | (e) The department shall establish procedures to administer |
|---|
| 32 | 32 | | the grant program, including a procedure for the submission of a |
|---|
| 33 | 33 | | proposal and a procedure to be used by the department to evaluate a |
|---|
| 34 | 34 | | proposal. |
|---|
| 35 | 35 | | (f) The department shall enter into a contract that includes |
|---|
| 36 | 36 | | performance requirements with each grant recipient. The |
|---|
| 37 | 37 | | department shall monitor and enforce the terms of the |
|---|
| 38 | 38 | | contract. The contract must authorize the department to recoup |
|---|
| 39 | 39 | | grant money from a grant recipient for failure of the grant |
|---|
| 40 | 40 | | recipient to comply with the terms of the contract. |
|---|
| 41 | 41 | | (g) The legislature may not appropriate money, other than |
|---|
| 42 | 42 | | money described by Subsection (h), for the purpose of awarding |
|---|
| 43 | 43 | | grants under this section. |
|---|
| 44 | 44 | | (h) The department may solicit and accept gifts, grants, and |
|---|
| 45 | 45 | | donations from any public or private source to implement this |
|---|
| 46 | 46 | | subchapter. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect September 1, 2015. |
