55 AN ACT
66 relating to an exemption from the sales tax for Firearms and Firearm
77 supplies for a limited period.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter H, Chapter 151, Tax Code, is amended
1010 by adding Section 151.358 to read as follows:
1111 Sec. 151.358. FIREARMS AND FIREARM SUPPLIES FOR LIMITED
1212 PERIOD. (a) In this section, "firearm supplies" means ammunition,
1313 firearm cleaning supplies, gun cases and gun safes, firearm optics,
1414 and trigger locking devices.
1515 (b) The sale of a firearm or firearm supplies is exempted
1616 from the taxes imposed by this chapter, if the sale takes place
1717 during a period beginning at 12:01 a.m. on the Friday before the
1818 last full weekend before the first opening day of dove hunting
1919 season in this state as determined by the Parks and Wildlife
2020 Department in each year and ending at 12 midnight on the following
2121 Sunday; or
2222 (c) if this act fails to take effect before September 1,
2323 2015, the sale of firearm or firearm supplies is exempted from the
2424 taxes imposed by this chapter, if the sale takes place in the year
2525 2015, during a period beginning at 12:01 a.m. on the Friday of
2626 September 4, 2015 and ending at 12 midnight on the following Sunday.
2727 After which, the sale of a firearm or firearm supplies is exempted
2828 from the taxes imposed by this chapter, if the sale takes place
2929 during a period beginning at 12:01 a.m. on the Friday before the
3030 last full weekend before the first opening day of dove hunting
3131 season in this state as determined by the Parks and Wildlife
3232 Department in each year and ending at 12 midnight on the following
3333 Sunday.
3434 SECTION 3. The change in law made by this Act does not
3535 affect tax liability accruing before the effective date of this
3636 Act. That liability continues in effect as if this Act had not been
3737 enacted, and the former law is continued in effect for the
3838 collection of taxes due and for civil and criminal enforcement of
3939 the liability for those taxes.
4040 SECTION 4. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2015.
