23 | 6 | | commercial motor vehicle safety standards. |

24 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
25 | 8 | | SECTION 1. Section 644.101(b), Transportation Code, is |
---|
26 | 9 | | amended to read as follows: |
---|
27 | 10 | | (b) A police officer of any of the following municipalities |
---|
28 | 11 | | is eligible to apply for certification under this section: |
---|
29 | 12 | | (1) a municipality with a population of 50,000 or |
---|
30 | 13 | | more; |
---|
31 | 14 | | (2) a municipality with a population of 25,000 or more |
---|
32 | 15 | | any part of which is located in a county with a population of |
---|
33 | 16 | | 500,000 or more; |
---|
34 | 17 | | (3) a municipality with a population of less than |
---|
35 | 18 | | 25,000: |
---|
36 | 19 | | (A) any part of which is located in a county with |
---|
37 | 20 | | a population of 3.3 million; and |
---|
38 | 21 | | (B) that contains or is adjacent to an |
---|
39 | 22 | | international port; |
---|
40 | 23 | | (4) a municipality with a population of at least |
---|
41 | 24 | | 34,000 that is located in a county that borders two or more states; |
---|
42 | 25 | | (5) a municipality any part of which is located in a |
---|
43 | 26 | | county bordering the United Mexican States; |
---|
44 | 27 | | (6) a municipality with a population of less than |
---|
45 | 28 | | 5,000 that is located: |
---|
46 | 29 | | (A) adjacent to a bay connected to the Gulf of |
---|
47 | 30 | | Mexico; and |
---|
48 | 31 | | (B) in a county adjacent to a county with a |
---|
49 | 32 | | population greater than 3.3 million; |
---|
50 | 33 | | (7) a municipality that is located: |
---|
51 | 34 | | (A) within 25 miles of an international port; and |
---|
52 | 35 | | (B) in a county that does not contain a highway |
---|
53 | 36 | | that is part of the national system of interstate and defense |
---|
54 | 37 | | highways and is adjacent to a county with a population greater than |
---|
55 | 38 | | 3.3 million; [or] |
---|
56 | 39 | | (8) a municipality with a population of less than |
---|
57 | 40 | | 8,500 that: |
---|
58 | 41 | | (A) is the county seat; and |
---|
59 | 42 | | (B) contains a highway that is part of the |
---|
60 | 43 | | national system of interstate and defense highways; or |
---|
61 | 44 | | (9) a municipality located in a county with a |
---|
62 | 45 | | population between 60,000 and 66,000 adjacent to a bay connected to |
---|
63 | 46 | | the Gulf of Mexico. |
---|
64 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
---|
65 | 48 | | a vote of two-thirds of all the members elected to each house, as |
---|
66 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
67 | 50 | | Act does not receive the vote necessary for immediate effect, this |
---|
68 | 51 | | Act takes effect September 1, 2015. |
