9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 39.023, Education Code, is amended by |
---|
11 | 11 | | adding Subsection (b-2) to read as follows: |
---|
12 | 12 | | (b-2) In addition to assessment instruments redeveloped as |
---|
13 | 13 | | provided by Subsection (b-1), the agency, in conjunction with |
---|
14 | 14 | | appropriate interested persons, shall develop, in a manner |
---|
15 | 15 | | consistent with federal law, alternative methods for assessing |
---|
16 | 16 | | significantly cognitively disabled students and medically fragile |
---|
17 | 17 | | students in a special education program under Subchapter A, Chapter |
---|
18 | 18 | | 29, for whom an assessment instrument under Subsection (b) or (b-1) |
---|
19 | 19 | | would not provide an appropriate measure of student achievement, as |
---|
20 | 20 | | determined by the student's admission, review, and dismissal |
---|
21 | 21 | | committee. An alternative method for assessing students under this |
---|
22 | 22 | | subsection may include, to the extent consistent with federal law, |
---|
23 | 23 | | portfolio assessment to evaluate student learning through a series |
---|
24 | 24 | | of student-produced work aligned to curriculum categories. The |
---|
25 | 25 | | commissioner by rule shall adopt procedures as necessary to enable |
---|
26 | 26 | | the administration of assessments developed under this subsection. |
---|
27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
---|
28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
---|
29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
---|
31 | 31 | | Act takes effect September 1, 2015. |
