55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to academic assessment of public school students with
88 significant disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.023, Education Code, is amended by
1111 adding Subsection (b-2) to read as follows:
1212 (b-2) In addition to assessment instruments redeveloped as
1313 provided by Subsection (b-1), the agency, in conjunction with
1414 appropriate interested persons, shall develop, in a manner
1515 consistent with federal law, alternative methods for assessing
1616 significantly cognitively disabled students and medically fragile
1717 students in a special education program under Subchapter A, Chapter
1818 29, for whom an assessment instrument under Subsection (b) or (b-1)
1919 would not provide an appropriate measure of student achievement, as
2020 determined by the student's admission, review, and dismissal
2121 committee. An alternative method for assessing students under this
2222 subsection may include, to the extent consistent with federal law,
2323 portfolio assessment to evaluate student learning through a series
2424 of student-produced work aligned to curriculum categories. The
2525 commissioner by rule shall adopt procedures as necessary to enable
2626 the administration of assessments developed under this subsection.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2015.
