55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring governmental entities to participate in the
88 federal electronic verification of employment authorization
99 program or E-verify.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle A, Title 6, Government Code, is amended
1212 by adding Chapter 619 to read as follows:
1313 CHAPTER 619. VERIFICATION OF EMPLOYEE INFORMATION
1414 Sec. 619.001. DEFINITIONS. In this chapter:
1515 (1) "E-verify program" means the electronic
1616 verification of employment authorization program of the federal
1717 Illegal Immigration Reform and Immigrant Responsibility Act of 1996
1818 (Pub. L. No. 104-208, reprinted in note, 8 U.S.C. Section 1324a),
1919 operated by the United States Department of Homeland Security, or a
2020 successor employment authorization program designated by the
2121 United States Department of Homeland Security or other federal
2222 agency authorized to verify the employment authorization status of
2323 newly hired employees under the federal Immigration Reform and
2424 Control Act of 1986 (8 U.S.C. Section 1101 et seq.).
2525 (2) "Governmental entity" means:
2626 (A) the state; or
2727 (B) a political subdivision of the state,
2828 including a municipality, a county, or any kind of district.
2929 Sec. 619.002. VERIFICATION. A governmental entity shall
3030 register and participate in the E-verify program to verify
3131 information of all new employees.
3232 Sec. 619.003. RULES. The Texas Workforce Commission shall
3333 adopt rules and prescribe forms to implement this chapter.
3434 Sec. 619.004. TERMINATION OF EMPLOYMENT. An employee of a
3535 governmental entity who is responsible for verifying information of
3636 new employees of the governmental entity as required by Section
3737 619.002 is subject to immediate termination of employment if the
3838 employee fails to comply with that section.
3939 SECTION 2. This Act takes effect September 1, 2015.
