66 AN ACT
77 relating to electronic benefits transfer cards used for recipients
88 of benefits under certain assistance programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0911 to read as follows:
1212 Sec. 531.0911. PHOTOGRAPH ON CERTAIN ELECTRONIC BENEFITS
1313 TRANSFER CARDS. (a) In this section:
1414 (1) "Financial assistance program" means the
1515 financial assistance program established under Chapter 31, Human
1616 Resources Code.
1717 (2) "Recipient" means a person who receives benefits
1818 under the financial assistance program or the supplemental
1919 nutrition assistance program.
2020 (3) "Supplemental nutrition assistance program" has
2121 the meaning assigned by Section 33.051, Human Resources Code.
2222 (b) The commission shall ensure that each electronic
2323 benefits transfer card used by a recipient, or other person
2424 authorized on the recipient's account, for purposes of receiving
2525 benefits under the financial assistance program or the supplemental
2626 nutrition assistance program displays the name and photograph of
2727 the recipient or other authorized person, as appropriate.
2828 SECTION 2. Not later than January 1, 2016, the Health and
2929 Human Services Commission shall ensure that electronic benefits
3030 transfer cards used on or after that date to deliver benefits to
3131 recipients under the financial assistance program under Chapter 31,
3232 Human Resources Code, and the supplemental nutrition assistance
3333 program under Chapter 33, Human Resources Code, conform to Section
3434 531.0911, Government Code, as added by this Act.
3535 SECTION 3. If before implementing any provision of this Act
3636 a state agency determines that a waiver or authorization from a
3737 federal agency is necessary for implementation of that provision,
3838 the agency affected by the provision shall request the waiver or
3939 authorization and may delay implementing that provision until the
4040 waiver or authorization is granted.
4141 SECTION 4. This Act takes effect September 1, 2015.
