55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the payment for services provided by certain types of
88 health care practitioners under contracts between the
99 practitioners and managed care health benefit plans.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 1451, Insurance Code, is
1212 amended by adding Section 1451.1041 to read as follows:
1313 Sec. 1451.1041. NONDISCRIMINATORY PAYMENT OF NETWORK
1414 PRACTITIONERS. (a) In this section, "managed care plan" means a
1515 plan under which a health maintenance organization, preferred
1616 provider benefit plan issuer, or other organization provides or
1717 arranges for health care benefits to plan participants and requires
1818 or encourages plan participants to use health care practitioners
1919 the plan designates.
2020 (b) In entering into contracts for the provision of health
2121 care services to managed care plan participants by health care
2222 practitioners eligible to be selected under this subchapter, the
2323 issuer of a managed care plan may not differentiate among those
2424 types of practitioners in the amount to be paid by the plan issuer,
2525 or the method to be used by the plan issuer to compute the amount to
2626 be paid by the plan issuer, for the performance of a covered
2727 physical modality or procedure that is within the scope of the
2828 license of more than one of those types of practitioners.
2929 SECTION 2. The change in law made by this Act applies only
3030 to contracts entered into or renewed on or after the effective date
3131 of this Act.
3232 SECTION 3. This Act takes effect September 1, 2015.
