6	6	AN ACT
7	7	relating to the payment for services provided by certain types of
8	8	health care practitioners under contracts between the
9	9	practitioners and managed care health benefit plans.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter C, Chapter 1451, Insurance Code, is
12	12	amended by adding Section 1451.1041 to read as follows:
13	13	Sec. 1451.1041. NONDISCRIMINATORY PAYMENT OF NETWORK
14	14	PRACTITIONERS. (a) In this section, "managed care plan" means a
15	15	plan under which a health maintenance organization, preferred
16	16	provider benefit plan issuer, or other organization provides or
17	17	arranges for health care benefits to plan participants and requires
18	18	or encourages plan participants to use health care practitioners
19	19	the plan designates.
20	20	(b) In entering into contracts for the provision of health
21	21	care services to managed care plan participants by health care
22	22	practitioners eligible to be selected under this subchapter, the
23	23	issuer of a managed care plan may not differentiate among those
24	24	types of practitioners in the amount to be paid by the plan issuer,
25	25	or the method to be used by the plan issuer to compute the amount to
26	26	be paid by the plan issuer, for the performance of a covered
27	27	physical modality or procedure that is within the scope of the
28	28	license of more than one of those types of practitioners.
29	29	SECTION 2. The change in law made by this Act applies only
30	30	to contracts entered into or renewed on or after the effective date
31	31	of this Act.
32	32	SECTION 3. This Act takes effect September 1, 2015.
