| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter B, Chapter 542, Insurance Code, is | |
| 11 | 11 | amended by adding Section 542.062 to read as follows: | |
| 12 | 12 | Sec. 542.062. LIMITATIONS PERIOD. A person must bring an | |
| 13 | 13 | action under this subchapter not later than four years after the | |
| 14 | 14 | earlier of the date of: | |
| 15 | 15 | (1) the rejection of the claim; or | |
| 16 | 16 | (2) the act or omission giving rise to the cause of | |
| 17 | 17 | action under this subchapter. | |
| 18 | 18 | SECTION 2. The change in law made by this Act applies only | |
| 19 | 19 | to a cause of action that accrues on or after the effective date of | |
| 20 | 20 | this Act. A cause of action that accrues before the effective date | |
| 21 | 21 | of this Act is governed by the law applicable to the cause of action | |
| 22 | 22 | immediately before the effective date of this Act, and that law is | |
| 23 | 23 | continued in effect for that purpose. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2015. |
