55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing the issuance of revenue bonds to fund an
88 academic building at the University of Houston.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1111 amended by adding Section 55.17831 to read as follows:
1212 Sec. 55.17831. UNIVERSITY OF HOUSTON SYSTEM; ADDITIONAL
1313 BONDS. (a) In addition to the other authority granted by this
1414 subchapter, the board of regents of the University of Houston
1515 System may acquire, purchase, construct, improve, renovate,
1616 enlarge, or equip property and facilities, including roads and
1717 related infrastructure, for an academic building located in Sugar
1818 Land, Texas, to be financed through the issuance of bonds in
1919 accordance with this subchapter, including bonds issued in
2020 accordance with a systemwide revenue financing program and secured
2121 as provided by that program, in an aggregate principal amount not to
2222 exceed $91,350,000.
2323 (b) The board may pledge irrevocably to the payment of bonds
2424 authorized by this section all or any part of the revenue funds of
2525 an institution, branch, or entity of the University of Houston
2626 System, including student tuition charges. The amount of a pledge
2727 made under this subsection may not be reduced or abrogated while the
2828 bonds for which the pledge is made, or bonds issued to refund those
2929 bonds, are outstanding.
3030 (c) If sufficient funds are not available to the board to
3131 meet its obligations under this section, the board may transfer
3232 funds among institutions, branches, and entities of the University
3333 of Houston System to ensure the most equitable and efficient
3434 allocation of available resources for each institution, branch, or
3535 entity to carry out its duties and purposes.
3636 (d) Any portion of the proceeds of bonds authorized by this
3737 section that is not required for the specific project for which the
3838 bonds are authorized may be used to renovate existing structures
3939 and facilities at the University of Houston.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2015.
