| 11 | 5 | | relating to the purchase of certain insurance coverage and the |
|---|
| 12 | 6 | | performance of related risk management services for the Texas State |
|---|
| 13 | 7 | | University System and the component institutions of that system. |
|---|
| 14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 9 | | SECTION 1. Section 412.011, Labor Code, is amended by |
|---|
| 16 | 10 | | amending Subsections (c) and (e) and adding Subsection (j) to read |
|---|
| 17 | 11 | | as follows: |
|---|
| 18 | 12 | | (c) The office shall: |
|---|
| 19 | 13 | | (1) perform risk management for each state agency |
|---|
| 20 | 14 | | subject to this chapter, except to any extent limited by Subsection |
|---|
| 21 | 15 | | (j) [Chapter 412]; and |
|---|
| 22 | 16 | | (2) purchase insurance coverage under any line of |
|---|
| 23 | 17 | | insurance other than health or life insurance, including liability |
|---|
| 24 | 18 | | insurance authorized under Chapter 612, Government Code, for a |
|---|
| 25 | 19 | | state agency subject to Chapter 501, except for: |
|---|
| 26 | 20 | | (A) an institution subject to Section 501.022; or |
|---|
| 27 | 21 | | (B) the Texas State University System or a |
|---|
| 28 | 22 | | component institution of that system[, under any line of insurance |
|---|
| 29 | 23 | | other than health or life insurance, including liability insurance |
|---|
| 30 | 24 | | authorized under Chapter 612, Government Code]. |
|---|
| 31 | 25 | | (e) A state agency subject to Chapter 501, except for an |
|---|
| 32 | 26 | | institution subject to Section 501.022 or the Texas State |
|---|
| 33 | 27 | | University System or a component institution of that system, may |
|---|
| 34 | 28 | | not purchase property, casualty, or liability insurance coverage |
|---|
| 35 | 29 | | without the approval of the board. |
|---|
| 36 | 30 | | (j) The Texas State University System or a component |
|---|
| 37 | 31 | | institution of that system shall perform risk management services |
|---|
| 38 | 32 | | related to insurance coverage purchased by the system or |
|---|
| 39 | 33 | | institution without board approval. |
|---|
| 40 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 41 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 38 | | Act takes effect September 1, 2015. |
