| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 2303.159, Occupations Code, is amended |
|---|
| 15 | 9 | | by amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 16 | 10 | | follows: |
|---|
| 17 | 11 | | (a) The operator of a vehicle storage facility shall accept |
|---|
| 18 | 12 | | each of the following forms of payment [by an electronic check, |
|---|
| 19 | 13 | | debit card, or credit card] for any charge associated with delivery |
|---|
| 20 | 14 | | or storage of a vehicle: |
|---|
| 21 | 15 | | (1) cash; |
|---|
| 22 | 16 | | (2) debit card; and |
|---|
| 23 | 17 | | (3) credit card. |
|---|
| 24 | 18 | | (a-1) The operator of a vehicle storage facility shall |
|---|
| 25 | 19 | | conspicuously post a sign that states: "This vehicle storage |
|---|
| 26 | 20 | | facility must accept payment by cash, [an electronic check,] credit |
|---|
| 27 | 21 | | card, and [or] debit card for any fee or charge associated with |
|---|
| 28 | 22 | | delivery or storage of a vehicle." The operator of a vehicle |
|---|
| 29 | 23 | | storage facility may not refuse to release a vehicle based on the |
|---|
| 30 | 24 | | inability of the facility to accept payment by [electronic check,] |
|---|
| 31 | 25 | | debit card[,] or credit card of a fee or charge associated with |
|---|
| 32 | 26 | | delivery or storage of the vehicle unless the operator, through no |
|---|
| 33 | 27 | | fault of the operator, is unable to accept the [electronic check,] |
|---|
| 34 | 28 | | debit card[,] or credit card because of a power outage or a machine |
|---|
| 35 | 29 | | malfunction. |
