55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of and qualifications for appointment
88 to the Texas Animal Health Commission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 161.021, Agriculture Code, is amended by
1111 amending Subsections (a) and (d) and adding Subsection (a-1) to
1212 read as follows:
1313 (a) The commission is composed of 15 [13] commissioners
1414 appointed by the governor with the advice and consent of the senate,
1515 with the appropriate number from each of the following categories:
1616 (1) a practitioner of veterinary medicine;
1717 (2) a dairyman;
1818 (3) a cattle raiser;
1919 (4) a hog raiser;
2020 (5) a sheep or goat raiser;
2121 (6) a poultry raiser;
2222 (7) an individual involved in the equine industry;
2323 (8) an individual involved in the feedlot industry;
2424 (9) an individual involved in the livestock marketing
2525 industry;
2626 (10) three members of the general public; [and]
2727 (11) an individual involved in the exotic livestock or
2828 exotic fowl industry;
2929 (12) an individual who raises livestock, but not more
3030 than 20 animal units each year as provided by Subsection (a-1); and
3131 (13) an individual who raises poultry, but not more
3232 than 100 birds each year.
3333 (a-1) For purposes of Subsection (a)(12), the Texas A&M
3434 AgriLife Extension Service shall adopt rules to determine how many
3535 livestock of a species constitute an animal unit based on the amount
3636 of forage consumed by livestock of that species.
3737 (d) A person is not eligible for appointment as a public
3838 member of the commission if the person or the person's spouse:
3939 (1) is registered, certified, or licensed by the
4040 commission;
4141 (2) is employed by or participates in the management
4242 of a business entity or other organization:
4343 (A) regulated by the commission;
4444 (B) [or] receiving money from the commission; or
4545 (C) a significant portion of the operations of
4646 which involves animals that are regulated by the commission;
4747 (3) owns or controls, directly or indirectly, more
4848 than a 10 percent interest in a business entity or other
4949 organization:
5050 (A) regulated by the commission;
5151 (B) [or] receiving money from the commission;
5252 or
5353 (C) a significant portion of the operations of
5454 which involves animals that are regulated by the commission; or
5555 (4) uses or receives a substantial amount of tangible
5656 goods, services, or money from the commission, other than
5757 compensation or reimbursement authorized by law for commission
5858 membership, attendance, or expenses.
5959 SECTION 2. Section 161.022, Agriculture Code, is amended to
6060 read as follows:
6161 Sec. 161.022. TERM. Commissioners serve for staggered
6262 terms of six years, with the terms of [four or] five members
6363 expiring every other year.
6464 SECTION 3. As soon as practicable before, on, or after the
6565 effective date of this Act, the Texas A&M AgriLife Extension
6666 Service shall adopt rules under Section 161.021(a-1), Agriculture
6767 Code, as added by this Act.
6868 SECTION 4. As soon as practicable after the Texas A&M
6969 AgriLife Extension Service adopts rules under Section
7070 161.021(a-1), Agriculture Code, as added by this Act, the governor
7171 shall appoint the members of the Texas Animal Health Commission
7272 under Sections 161.021(a)(12) and (13), Agriculture Code, as added
7373 by this Act. The governor shall appoint one member to a term
7474 expiring in September 2017 and one member to a term expiring in
7575 September 2021.
7676 SECTION 5. A public member of the Texas Animal Health
7777 Commission who does not meet the qualifications for office under
7878 Section 161.021(d), Agriculture Code, as amended by this Act, on
7979 the effective date of this Act is removed from office on that date.
8080 If a public member is removed as provided by this section, the
8181 governor shall appoint a replacement to a term complying with
8282 Section 161.022, Agriculture Code, as amended by this Act.
8383 SECTION 6. This Act takes effect September 1, 2015.
