55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the offense of online solicitation
88 of a minor.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 33.021(a)(1), Penal Code, is amended to
1111 read as follows:
1212 (1) "Minor" means:
1313 (A) an individual who is [represents himself or
1414 herself to be] younger than 17 years of age; or
1515 (B) an individual whom the actor believes to be
1616 younger than 17 years of age.
1717 SECTION 2. Section 33.021, Penal Code, is amended by
1818 amending Subsections (b), (d), and (e) to read as follows:
1919 (b) A person who is 17 years of age or older commits an
2020 offense if, with the intent to commit an offense listed in Article
2121 62.001(5)(A), (B), or (K), Code of Criminal Procedure [arouse or
2222 gratify the sexual desire of any person], the person, over the
2323 Internet, by electronic mail or text message or other electronic
2424 message service or system, or through a commercial online service,
2525 intentionally:
2626 (1) communicates in a sexually explicit manner with a
2727 minor; or
2828 (2) distributes sexually explicit material to a minor.
2929 (d) It is not a defense to prosecution under Subsection (c)
3030 that[:
3131 [(1)] the meeting did not occur[;
3232 [(2) the actor did not intend for the meeting to occur;
3333 or
3434 [(3) the actor was engaged in a fantasy at the time of
3535 commission of the offense].
3636 (e) It is a defense to prosecution under this section that
3737 at the time conduct described by Subsection [(b) or] (c) was
3838 committed:
3939 (1) the actor was married to the minor; or
4040 (2) the actor was not more than three years older than
4141 the minor and the minor consented to the conduct.
4242 SECTION 3. The change in law made by this Act applies only
4343 to an offense committed on or after the effective date of this Act.
4444 An offense committed before the effective date of this Act is
4545 governed by the law in effect on the date the offense was committed,
4646 and the former law is continued in effect for that purpose. For
4747 purposes of this section, an offense was committed before the
4848 effective date of this Act if any element of the offense occurred
4949 before that date.
5050 SECTION 4. This Act takes effect September 1, 2015.
