55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to inclusion of a civics test in the graduation
88 requirements for public high school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.025(c), Education Code, is amended to
1111 read as follows:
1212 (c) A person may receive a diploma if the person is eligible
1313 for a diploma under Section 28.0251. In other cases, a student may
1414 graduate and receive a diploma only if:
1515 (1) the student successfully completes the curriculum
1616 requirements identified by the State Board of Education under
1717 Subsection (a) and complies with Sections 28.0259 and [Section]
1818 39.025; or
1919 (2) the student successfully completes an
2020 individualized education program developed under Section 29.005.
2121 SECTION 2. Subchapter B, Chapter 28, Education Code, is
2222 amended by adding Section 28.0259 to read as follows:
2323 Sec. 28.0259. CIVICS TEST. (a) The commissioner shall
2424 adopt rules requiring a student in the foundation high school
2525 program under Section 28.025 to be administered a civics test. A
2626 student may not receive a high school diploma until the student has
2727 performed satisfactorily on the civics test.
2828 (b) The civics test is composed of all or a portion of the
2929 questions on the civics test administered by the United States
3030 Citizenship and Immigration Services as part of the naturalization
3131 process under the federal Immigration and Nationality Act (8 U.S.C.
3232 Section 1101 et seq.).
3333 (c) The commissioner by rule shall determine:
3434 (1) the length and format of the test;
3535 (2) the high school grade level or levels at which the
3636 test may be taken; and
3737 (3) the score that indicates satisfactory
3838 performance.
3939 SECTION 3. This Act applies beginning with students who
4040 enter the ninth grade during the 2015-2016 school year.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2015.
