55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the possession of certain weapons by a security guard on
88 the premises of a school or educational institution.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.03, Penal Code, is amended by adding
1111 Subsection (j) to read as follows:
1212 (j) It is an exception to the application of Subsection
1313 (a)(1) that the actor possessed a firearm or club while traveling to
1414 or from the actor's place of assignment or in the actual discharge
1515 of the actor's duties as a security officer if:
1616 (1) the actor holds a security officer commission
1717 issued by the Texas Private Security Board;
1818 (2) the actor is wearing a distinctive uniform; and
1919 (3) the firearm or club is in plain view.
2020 SECTION 2. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 governed by the law in effect on the date the offense was committed,
2424 and the former law is continued in effect for that purpose. For
2525 purposes of this section, an offense was committed before the
2626 effective date of this Act if any element of the offense occurred
2727 before that date.
2828 SECTION 3. This Act takes effect September 1, 2015.
