| 7 | 7 | | relating to the eligibility for a manicurist license or a barber |

| 8 | 8 | | technician/manicurist specialty license. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 1601.257(b) and (c), Occupations Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (b) An applicant for a manicurist license must: |
|---|
| 13 | 13 | | (1) be at least 17 years of age; |
|---|
| 14 | 14 | | (2) have completed the seventh grade or the equivalent |
|---|
| 15 | 15 | | of the seventh grade; |
|---|
| 16 | 16 | | (3) have completed a commission-approved training |
|---|
| 17 | 17 | | program consisting of 100 [600] hours of instruction in manicuring; |
|---|
| 18 | 18 | | and |
|---|
| 19 | 19 | | (4) submit the required fee with the application. |
|---|
| 20 | 20 | | (c) The department shall issue a manicurist license to an |
|---|
| 21 | 21 | | applicant who: |
|---|
| 22 | 22 | | (1) possesses the qualifications described by |
|---|
| 23 | 23 | | Subsection (b); |
|---|
| 24 | 24 | | (2) passes a practical [the appropriate] examination; |
|---|
| 25 | 25 | | (3) pays the required license fee; and |
|---|
| 26 | 26 | | (4) has not committed an act that is a ground for |
|---|
| 27 | 27 | | denial of a license. |
|---|
| 28 | 28 | | SECTION 2. Section 1601.262(c), Occupations Code, is |
|---|
| 29 | 29 | | amended to read as follows: |
|---|
| 30 | 30 | | (c) An applicant who qualifies under Subsection (b)(3)(B) |
|---|
| 31 | 31 | | must: |
|---|
| 32 | 32 | | (1) be at least 17 years of age and have completed the |
|---|
| 33 | 33 | | seventh grade or its equivalent; and |
|---|
| 34 | 34 | | (2) have completed: |
|---|
| 35 | 35 | | (A) 400 [900] hours of instruction in a barber |
|---|
| 36 | 36 | | technician/manicurist curriculum in a commission-approved training |
|---|
| 37 | 37 | | program, with 100 hours of instruction dedicated to manicuring; or |
|---|
| 38 | 38 | | (B) 100 [600] hours of instruction in a manicure |
|---|
| 39 | 39 | | curriculum and 300 hours of instruction in a barber technician |
|---|
| 40 | 40 | | curriculum in a commission-approved training program. |
|---|
| 41 | 41 | | SECTION 3. The changes in law made by this Act to Sections |
|---|
| 42 | 42 | | 1601.257 and 1601.262, Occupations Code, apply only to an |
|---|
| 43 | 43 | | application for a manicurist license or barber |
|---|
| 44 | 44 | | technician/manicurist specialty license submitted on or after the |
|---|
| 45 | 45 | | effective date of this Act. An application for a manicurist license |
|---|
| 46 | 46 | | or barber technician/manicurist specialty license submitted before |
|---|
| 47 | 47 | | the effective date of this Act is governed by the law in effect on |
|---|
| 48 | 48 | | the date the application was submitted, and the former law is |
|---|
| 49 | 49 | | continued in effect for that purpose. |
|---|
| 50 | 50 | | SECTION 4. This Act takes effect September 1, 2015. |
