55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility for a manicurist license or a barber
88 technician/manicurist specialty license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 1601.257(b) and (c), Occupations Code,
1111 are amended to read as follows:
1212 (b) An applicant for a manicurist license must:
1313 (1) be at least 17 years of age;
1414 (2) have completed the seventh grade or the equivalent
1515 of the seventh grade;
1616 (3) have completed a commission-approved training
1717 program consisting of 100 [600] hours of instruction in manicuring;
1818 and
1919 (4) submit the required fee with the application.
2020 (c) The department shall issue a manicurist license to an
2121 applicant who:
2222 (1) possesses the qualifications described by
2323 Subsection (b);
2424 (2) passes a practical [the appropriate] examination;
2525 (3) pays the required license fee; and
2626 (4) has not committed an act that is a ground for
2727 denial of a license.
2828 SECTION 2. Section 1601.262(c), Occupations Code, is
2929 amended to read as follows:
3030 (c) An applicant who qualifies under Subsection (b)(3)(B)
3131 must:
3232 (1) be at least 17 years of age and have completed the
3333 seventh grade or its equivalent; and
3434 (2) have completed:
3535 (A) 400 [900] hours of instruction in a barber
3636 technician/manicurist curriculum in a commission-approved training
3737 program, with 100 hours of instruction dedicated to manicuring; or
3838 (B) 100 [600] hours of instruction in a manicure
3939 curriculum and 300 hours of instruction in a barber technician
4040 curriculum in a commission-approved training program.
4141 SECTION 3. The changes in law made by this Act to Sections
4242 1601.257 and 1601.262, Occupations Code, apply only to an
4343 application for a manicurist license or barber
4444 technician/manicurist specialty license submitted on or after the
4545 effective date of this Act. An application for a manicurist license
4646 or barber technician/manicurist specialty license submitted before
4747 the effective date of this Act is governed by the law in effect on
4848 the date the application was submitted, and the former law is
4949 continued in effect for that purpose.
5050 SECTION 4. This Act takes effect September 1, 2015.
