A BILL TO BE ENTITLED
AN ACT
relating to qualifications for a backflow prevention assembly
tester license.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 37.004, Water Code, is amended to read as
follows:
Sec. 37.004. QUALIFICATIONS. (a) The commission shall
establish the qualifications required by this section and, except
as limited by Subsection (b), may establish additional
qualifications for each license and registration issued under this
chapter.
(b) The commission shall require an applicant for a backflow
prevention assembly tester license to pass an examination and
complete an approved 40-hour backflow prevention assembly testing
training course. The commission may not require work experience for
issuance of a backflow prevention assembly tester license.
SECTION 2. (a) The Texas Commission on Environmental
Quality shall adopt the rules necessary to implement Section
37.004, Water Code, as amended by this Act, not later than December
1, 2015.
(b) The change in law made by this Act applies only to an
application for a backflow prevention assembly tester license
submitted to the Texas Commission on Environmental Quality on or
after January 1, 2016. An application submitted before that date is
governed by the law in effect on the date the application was
submitted, and that law is continued in effect for that purpose.
SECTION 3. This Act takes effect September 1, 2015.
