7 | 7 | | relating to the creation of a joint interim committee to study and |
---|
8 | 8 | | make recommendations regarding the storage of biometric |
---|
9 | 9 | | identifiers. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. INTERIM COMMITTEE; STUDY; REPORT. (a) A joint |
---|
12 | 12 | | interim committee is created to study and review the methods by |
---|
13 | 13 | | which state agencies store biometric identifiers. |
---|
14 | 14 | | (b) The study must consider: |
---|
15 | 15 | | (1) the level of security currently provided by state |
---|
16 | 16 | | agencies to biometric identifiers stored by the agencies; |
---|
17 | 17 | | (2) what changes, if any, should be made to ensure that |
---|
18 | 18 | | biometric identifiers are stored in a manner that provides the |
---|
19 | 19 | | greatest level of security; and |
---|
20 | 20 | | (3) if the committee determines that an increase in |
---|
21 | 21 | | the level of security provided to biometric identifiers stored by |
---|
22 | 22 | | state agencies is warranted, whether additional funds are necessary |
---|
23 | 23 | | to increase security to an acceptable level. |
---|
24 | 24 | | (c) The committee is composed of: |
---|
25 | 25 | | (1) three senators appointed by the lieutenant |
---|
26 | 26 | | governor, one of whom the lieutenant governor shall designate as |
---|
27 | 27 | | cochair of the committee; and |
---|
28 | 28 | | (2) four state representatives appointed by the |
---|
29 | 29 | | speaker of the house of representatives, one of whom the speaker |
---|
30 | 30 | | shall designate as cochair of the committee. |
---|
31 | 31 | | (d) The committee shall convene at least twice at the call |
---|
32 | 32 | | of the cochairs. |
---|
33 | 33 | | (e) The committee has all other powers and duties provided |
---|
34 | 34 | | to a special or select committee by the rules of the senate and |
---|
35 | 35 | | house of representatives, by Subchapter B, Chapter 301, Government |
---|
36 | 36 | | Code, and by policies of the senate and house committees on |
---|
37 | 37 | | administration. |
---|
38 | 38 | | (f) Not later than December 1, 2016, the committee shall |
---|
39 | 39 | | report the committee's findings and recommendations to the members |
---|
40 | 40 | | of the legislature. The committee shall include in its |
---|
41 | 41 | | recommendations specific statutory and rule changes that appear |
---|
42 | 42 | | necessary from the results of the committee's study. |
---|
43 | 43 | | (g) Not later than the 60th day after the effective date of |
---|
44 | 44 | | this Act, the lieutenant governor and the speaker of the house of |
---|
45 | 45 | | representatives shall appoint the members of the committee created |
---|
46 | 46 | | under this section. |
---|
47 | 47 | | (h) The Texas Legislative Council shall provide any |
---|
48 | 48 | | necessary staff and resources to the committee created under this |
---|
49 | 49 | | section. |
---|
50 | 50 | | SECTION 2. ABOLITION OF COMMITTEE. The committee is |
---|
51 | 51 | | abolished and this Act expires March 1, 2017. |
---|
52 | 52 | | SECTION 3. EFFECTIVE DATE. This Act takes effect September |
---|
53 | 53 | | 1, 2015. |
