55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of a select committee to evaluate the
88 effects of a reduction in or the elimination of federal funding on
99 the state budget due to federal fiscal policy.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 10, Government Code, is
1212 amended by adding Chapter 2116 to read as follows:
1313 CHAPTER 2116. SELECT COMMITTEE ON BUDGET DEPENDENCE ON FEDERAL
1414 FUNDING
1515 Sec. 2116.001. DEFINITION. In this chapter, "committee"
1616 means the Select Committee on Budget Dependence on Federal Funding.
1717 Sec. 2116.002. COMPOSITION. (a) The committee is composed
1818 of:
1919 (1) four members of the senate, including members from
2020 different political parties, appointed by the lieutenant governor
2121 based on seniority;
2222 (2) four members of the house of representatives,
2323 including members from different political parties, appointed by
2424 the speaker of the house of representatives based on seniority;
2525 (3) a representative of a nonprofit or charitable
2626 organization appointed by the governor;
2727 (4) a representative of an advocacy organization
2828 focused on state and federal fiscal matters appointed by the
2929 governor;
3030 (5) a representative of the Legislative Budget Board
3131 appointed by the Legislative Budget Board; and
3232 (6) a representative of the comptroller's office,
3333 appointed by the comptroller.
3434 (b) The committee shall elect a presiding officer from among
3535 its members.
3636 Sec. 2116.003. COMPENSATION. A committee member serves
3737 without compensation but is entitled to reimbursement for actual
3838 and necessary expenses incurred in performing functions as a
3939 committee member, subject to any applicable limitation on
4040 reimbursement provided by general law or the General Appropriations
4141 Act.
4242 Sec. 2116.004. COMMITTEE DUTIES. The committee shall:
4343 (1) meet at the call of the presiding officer;
4444 (2) conduct a study on:
4545 (A) the percentage of the state budget that is
4646 funded by federal money; and
4747 (B) the effects on the state budget if federal
4848 fiscal policy necessitates a significant reduction in or the
4949 elimination of federal funding for state governments; and
5050 (3) create a plan to address the loss of federal money,
5151 including federal Medicaid matching money and federal social
5252 security payments, and maintain benefit programs and other
5353 essential state services if federal fiscal policy necessitates a
5454 significant reduction in or the elimination of federal funding for
5555 state governments.
5656 Sec. 2116.005. REPORT. Not later than September 1, 2016,
5757 the committee shall submit a report based on its findings to:
5858 (1) the governor;
5959 (2) the lieutenant governor; and
6060 (3) the speaker of the house of representatives.
6161 Sec. 2116.006. EXPIRATION. This chapter expires and the
6262 committee is abolished December 1, 2016.
6363 SECTION 2. (a) Not later than October 1, 2015, the
6464 lieutenant governor, the speaker of the house of representatives,
6565 the governor, the comptroller of public accounts, and the
6666 Legislative Budget Board shall make the appointments and
6767 designations required by Section 2116.002(a), Government Code, as
6868 added by this Act.
6969 (b) Not later than November 1, 2015, the governor shall call
7070 the first meeting of the Select Committee on Budget Dependence on
7171 Federal Funding to permit the committee to elect a presiding
7272 officer as required by Section 2116.002(b), Government Code, as
7373 added by this Act.
7474 SECTION 3. This Act takes effect September 1, 2015.
