| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 1956.038(b), Occupations Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (b) A metal recycling entity may only [not] pay for a | |
| 13 | 13 | purchase of regulated material by check mailed to the seller at the | |
| 14 | 14 | address shown on the seller's personal identification document [in | |
| 15 | 15 | cash if: | |
| 16 | 16 | [(1) the entity does not hold a certificate of | |
| 17 | 17 | registration under Subchapter A-2 and, if applicable, a license or | |
| 18 | 18 | permit required by a county, municipality, or other political | |
| 19 | 19 | subdivision as authorized under Section 1956.003(b); or | |
| 20 | 20 | [(2) the entity has been prohibited by the department | |
| 21 | 21 | from paying cash under Section 1956.036(e)]. | |
| 22 | 22 | SECTION 2. The following sections of the Occupations Code | |
| 23 | 23 | are repealed: | |
| 24 | 24 | (1) Section 1956.036(e); and | |
| 25 | 25 | (2) Sections 1956.038(c) and (d). | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2015. |
