| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 71, Penal Code, is amended by adding | |
| 11 | 11 | Section 71.024 to read as follows: | |
| 12 | 12 | Sec. 71.024. INTIMIDATION BY GANG MEMBER. (a) A person | |
| 13 | 13 | commits an offense if the person: | |
| 14 | 14 | (1) is a member of a criminal street gang; and | |
| 15 | 15 | (2) with the intent to cause another person to perform | |
| 16 | 16 | or to omit the performance of any act, communicates to the other | |
| 17 | 17 | person, directly or indirectly, by any means, a threat to: | |
| 18 | 18 | (A) inflict bodily injury on the person | |
| 19 | 19 | threatened or any other person; | |
| 20 | 20 | (B) damage or destroy property; | |
| 21 | 21 | (C) subject any person to physical confinement or | |
| 22 | 22 | restraint; or | |
| 23 | 23 | (D) commit a felony or a Class A misdemeanor. | |
| 24 | 24 | (b) An offense under this section is a felony of the third | |
| 25 | 25 | degree. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2015. |
