| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 3802.159(a) and (c), Special District |
|---|
| 11 | 11 | | Local Laws Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) In addition to the elections required under Subchapter |
|---|
| 13 | 13 | | L, Chapter 375, Local Government Code, the district must hold an |
|---|
| 14 | 14 | | election in the manner provided by that subchapter to obtain voter |
|---|
| 15 | 15 | | approval before the district may: |
|---|
| 16 | 16 | | (1) impose a maintenance tax; or |
|---|
| 17 | 17 | | (2) issue a bond payable from ad valorem taxes [or |
|---|
| 18 | 18 | | assessments]. |
|---|
| 19 | 19 | | (c) The board may not call a bond [an] election under this |
|---|
| 20 | 20 | | chapter unless a written petition requesting the [an] election has |
|---|
| 21 | 21 | | been filed with the board. The petition must be signed by: |
|---|
| 22 | 22 | | (1) the owners of a majority of the assessed value of |
|---|
| 23 | 23 | | real property in the district according to the most recent |
|---|
| 24 | 24 | | certified tax appraisal roll for Harris County; or |
|---|
| 25 | 25 | | (2) at least 50 persons who own property in the |
|---|
| 26 | 26 | | district, if there are more than 50 persons who own property in the |
|---|
| 27 | 27 | | district according to the most recent certified tax appraisal roll |
|---|
| 28 | 28 | | for Harris County. |
|---|
| 29 | 29 | | SECTION 2. Section 3802.104, Special District Local Laws |
|---|
| 30 | 30 | | Code, is repealed. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2015. |
