| 7 | 7 | | relating to evaluating the performance of dropout recovery schools. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 39.0545, Education Code, as added by |
|---|
| 10 | 10 | | Chapter 167 (S.B. 1538), Acts of the 83rd Legislature, Regular |
|---|
| 11 | 11 | | Session, 2013, is amended by amending Subsection (d) and adding |
|---|
| 12 | 12 | | Subsection (e) to read as follows: |
|---|
| 13 | 13 | | (d) For purposes of evaluating a dropout recovery school[, |
|---|
| 14 | 14 | | only the best result from the primary administration and any retake |
|---|
| 15 | 15 | | of an assessment instrument administered to a student in the school |
|---|
| 16 | 16 | | year evaluated] under the accountability procedures adopted by the |
|---|
| 17 | 17 | | commissioner: |
|---|
| 18 | 18 | | (1) only a student enrolled continuously for at least |
|---|
| 19 | 19 | | one semester may be included and [may be] considered in determining |
|---|
| 20 | 20 | | the performance rating of the school under Section 39.054; and |
|---|
| 21 | 21 | | (2) the results of the primary administration of an |
|---|
| 22 | 22 | | assessment instrument administered to a student and any retake of |
|---|
| 23 | 23 | | an assessment instrument administered to a student shall be |
|---|
| 24 | 24 | | included and considered in determining the performance rating of |
|---|
| 25 | 25 | | the school under Section 39.054. |
|---|
| 26 | 26 | | (e) For purposes of evaluating a dropout recovery school |
|---|
| 27 | 27 | | under the accountability procedures adopted by the commissioner, |
|---|
| 28 | 28 | | the commissioner: |
|---|
| 29 | 29 | | (1) may not authorize the use of a procedure to measure |
|---|
| 30 | 30 | | student growth that is based on the percentage of students who, |
|---|
| 31 | 31 | | based on each student's performance on an assessment instrument, |
|---|
| 32 | 32 | | satisfy an established growth performance standard; and |
|---|
| 33 | 33 | | (2) shall by rule establish a procedure to measure |
|---|
| 34 | 34 | | student growth by: |
|---|
| 35 | 35 | | (A) computing the average aggregate increase in |
|---|
| 36 | 36 | | each student's performance on an assessment instrument; and |
|---|
| 37 | 37 | | (B) including for purposes of the computation |
|---|
| 38 | 38 | | under Paragraph (A) the results of any primary administration of an |
|---|
| 39 | 39 | | assessment instrument administered to a student at another school |
|---|
| 40 | 40 | | if the retake of the assessment instrument is administered by the |
|---|
| 41 | 41 | | dropout recovery school. |
|---|
| 42 | 42 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 43 | 43 | | school year. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 48 | 48 | | Act takes effect September 1, 2015. |
