55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to evaluating the performance of dropout recovery schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 39.0545, Education Code, as added by
1010 Chapter 167 (S.B. 1538), Acts of the 83rd Legislature, Regular
1111 Session, 2013, is amended by amending Subsection (d) and adding
1212 Subsection (e) to read as follows:
1313 (d) For purposes of evaluating a dropout recovery school[,
1414 only the best result from the primary administration and any retake
1515 of an assessment instrument administered to a student in the school
1616 year evaluated] under the accountability procedures adopted by the
1717 commissioner:
1818 (1) only a student enrolled continuously for at least
1919 one semester may be included and [may be] considered in determining
2020 the performance rating of the school under Section 39.054; and
2121 (2) the results of the primary administration of an
2222 assessment instrument administered to a student and any retake of
2323 an assessment instrument administered to a student shall be
2424 included and considered in determining the performance rating of
2525 the school under Section 39.054.
2626 (e) For purposes of evaluating a dropout recovery school
2727 under the accountability procedures adopted by the commissioner,
2828 the commissioner:
2929 (1) may not authorize the use of a procedure to measure
3030 student growth that is based on the percentage of students who,
3131 based on each student's performance on an assessment instrument,
3232 satisfy an established growth performance standard; and
3333 (2) shall by rule establish a procedure to measure
3434 student growth by:
3535 (A) computing the average aggregate increase in
3636 each student's performance on an assessment instrument; and
3737 (B) including for purposes of the computation
3838 under Paragraph (A) the results of any primary administration of an
3939 assessment instrument administered to a student at another school
4040 if the retake of the assessment instrument is administered by the
4141 dropout recovery school.
4242 SECTION 2. This Act applies beginning with the 2015-2016
4343 school year.
4444 SECTION 3. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2015.
