| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle B, Title 2, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 49 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 49. TEXAS WOMEN'S HEALTH PROGRAM |
|---|
| 13 | 13 | | Sec. 49.001. DEFINITIONS. In this chapter: |
|---|
| 14 | 14 | | (1) "Commission" means the Health and Human Services |
|---|
| 15 | 15 | | Commission. |
|---|
| 16 | 16 | | (2) "Department" means the Department of State Health |
|---|
| 17 | 17 | | Services. |
|---|
| 18 | 18 | | (3) "Executive commissioner" means the executive |
|---|
| 19 | 19 | | commissioner of the commission. |
|---|
| 20 | 20 | | (4) "Texas women's health program" means a program |
|---|
| 21 | 21 | | operated by the department or the commission that is substantially |
|---|
| 22 | 22 | | similar to the demonstration project operated by the department |
|---|
| 23 | 23 | | under former Section 32.0248, Human Resources Code, and that is |
|---|
| 24 | 24 | | intended to expand access to preventive health and family planning |
|---|
| 25 | 25 | | services for women in this state. |
|---|
| 26 | 26 | | Sec. 49.002. AGE OF ELIGIBILITY. Subject to other |
|---|
| 27 | 27 | | eligibility criteria specified by rules adopted by the executive |
|---|
| 28 | 28 | | commissioner, a woman is eligible for benefits under the Texas |
|---|
| 29 | 29 | | women's health program if the woman is 15 years of age or older. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2015. |
