66 AN ACT
77 relating to eligibility for benefits under the Texas women's health
88 program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1111 amended by adding Chapter 49 to read as follows:
1212 CHAPTER 49. TEXAS WOMEN'S HEALTH PROGRAM
1313 Sec. 49.001. DEFINITIONS. In this chapter:
1414 (1) "Commission" means the Health and Human Services
1515 Commission.
1616 (2) "Department" means the Department of State Health
1717 Services.
1818 (3) "Executive commissioner" means the executive
1919 commissioner of the commission.
2020 (4) "Texas women's health program" means a program
2121 operated by the department or the commission that is substantially
2222 similar to the demonstration project operated by the department
2323 under former Section 32.0248, Human Resources Code, and that is
2424 intended to expand access to preventive health and family planning
2525 services for women in this state.
2626 Sec. 49.002. AGE OF ELIGIBILITY. Subject to other
2727 eligibility criteria specified by rules adopted by the executive
2828 commissioner, a woman is eligible for benefits under the Texas
2929 women's health program if the woman is 15 years of age or older.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2015.
