| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 79, Education Code, is amended by adding |
|---|
| 11 | 11 | | Section 79.11 to read as follows: |
|---|
| 12 | 12 | | Sec. 79.11. ELECTION FOR ATHLETICS NICKNAME. (a) The |
|---|
| 13 | 13 | | university shall hold an election to select the athletics nickname |
|---|
| 14 | 14 | | of the university. The university shall include on the ballot: |
|---|
| 15 | 15 | | (1) the "Broncs"; |
|---|
| 16 | 16 | | (2) the "Ocelots"; and |
|---|
| 17 | 17 | | (3) any other options the university chooses, |
|---|
| 18 | 18 | | including nicknames nominated by students and approved by the |
|---|
| 19 | 19 | | university. |
|---|
| 20 | 20 | | (b) The board shall designate as the athletics nickname of |
|---|
| 21 | 21 | | the university the nickname selected by a plurality vote of the |
|---|
| 22 | 22 | | students voting in the election held under Subsection (a). In case |
|---|
| 23 | 23 | | of a tie between nicknames receiving more votes than any other, the |
|---|
| 24 | 24 | | board shall designate the athletics nickname of the university by |
|---|
| 25 | 25 | | lot. |
|---|
| 26 | 26 | | SECTION 2. (a) The University of Texas Rio Grande Valley |
|---|
| 27 | 27 | | shall hold the election required under Section 79.11(a), Education |
|---|
| 28 | 28 | | Code, as added by this Act, not later than December 31, 2015. |
|---|
| 29 | 29 | | (b) The board of regents of The University of Texas System |
|---|
| 30 | 30 | | shall make the designation required under Section 79.11(b), |
|---|
| 31 | 31 | | Education Code, as added by this Act, not later than May 31, 2015, |
|---|
| 32 | 32 | | for application beginning with the 2016 fall semester. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2015. |
