115 relating to the continuation and duties of the Red River Boundary
126 Commission.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 12.056, Natural Resources Code, is
159 amended to read as follows:
1610 Sec. 12.056. POWERS AND DUTIES. The commission shall
1711 confer and act jointly with representatives appointed on behalf of
1812 the State of Oklahoma to:
1913 (1) evaluate the methods, surveys, historical maps,
2014 and other information used to establish the boundary line between
2115 this state and the State of Oklahoma in the Texoma area;
2216 (2) determine the location of the south bank of the Red
2317 River as the bank was located and marked by the United States Army
2418 Corps of Engineers before the beginning of construction of Lake
2519 Texoma, in accordance with Article II(c), Red River Boundary
2620 Compact, Section 12.002;
2721 (3) redraw the boundary line between this state and
2822 the State of Oklahoma on any real property for which the United
2923 States Army Corps of Engineers granted an easement before August
3024 31, 2000, to at least two districts or authorities created under
3125 Section 59, Article XVI, Texas Constitution, for the construction,
3226 operation, and maintenance of a water pipeline and related
3327 facilities in the Texoma area in order to negate any effects the
3428 boundary as it is currently drawn has on property interests
3529 associated with those easements in the Texoma area, in such a way
3630 that there is no net loss of property between either state so as to
3731 ensure that the redrawn boundary does not increase the political
3832 power or influence of either state, and in accordance with:
3933 (A) the Lake Texoma preconstruction survey of the
4034 south bank of the Red River prepared by the United States Army Corps
4135 of Engineers; or
4236 (B) other historical records or documentation of
4337 the United States Army Corps of Engineers identifying the location
4438 of the south bank of the Red River, if the survey described by
4539 Subdivision (3)(A) is unavailable;
4640 (4) hold hearings and conferences in this state and in
4741 the State of Oklahoma as necessary to accomplish the purposes of
4842 this section; and
4943 (5) take other action, alone or in cooperation with
5044 the State of Oklahoma or the United States, necessary to accomplish
5145 the purposes of this section.
5246 SECTION 2. Section 12.057(b), Natural Resources Code, is
5347 amended to read as follows:
5448 (b) Not later than July 30, 2017 [2015], the commission
5549 shall issue a final report to the governor, lieutenant governor,
5650 speaker of the house of representatives, and appropriate committees
5751 of the legislature.
5852 SECTION 3. Section 12.058, Natural Resources Code, is
5953 amended to read as follows:
6054 Sec. 12.058. EXPIRATION OF SUBCHAPTER. This subchapter
6155 expires December 31, 2017 [2015].
6256 SECTION 4. This Act takes effect immediately if it receives
6357 a vote of two-thirds of all the members elected to each house, as
6458 provided by Section 39, Article III, Texas Constitution. If this
6559 Act does not receive the vote necessary for immediate effect, this
6660 Act takes effect September 1, 2015.
