55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of an illegal knife.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 46.01(6), Penal Code, is amended to read
1010 as follows:
1111 (6) "Illegal knife" means a:
1212 (A) knife with a blade over five and one-half
1313 inches;
1414 (B) hand instrument designed to cut or stab
1515 another by being thrown;
1616 (C) dagger, including but not limited to a dirk,
1717 stiletto, and poniard;
1818 (D) [bowie knife;
1919 [(E)] sword; or
2020 (E) [(F)] spear.
2121 SECTION 2. Section 46.15(e), Penal Code, is amended to read
2222 as follows:
2323 (e) The provisions of Section 46.02 prohibiting the
2424 carrying of an illegal knife do not apply to an individual carrying
2525 a [bowie knife or a] sword used in a historical demonstration or in
2626 a ceremony in which the [knife or] sword is significant to the
2727 performance of the ceremony.
2828 SECTION 3. The change in law made by this Act applies only
2929 to an offense committed on or after the effective date of this Act.
3030 An offense committed before the effective date of this Act is
3131 governed by the law in effect on the date the offense was committed,
3232 and the former law is continued in effect for that purpose. For
3333 purposes of this section, an offense was committed before the
3434 effective date of this Act if any element of the offense occurred
3535 before that date.
3636 SECTION 4. This Act takes effect September 1, 2015.
