8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 46.01(6), Penal Code, is amended to read | |
10 | 10 | as follows: | |
11 | 11 | (6) "Illegal knife" means a: | |
12 | 12 | (A) knife with a blade over five and one-half | |
13 | 13 | inches; | |
14 | 14 | (B) hand instrument designed to cut or stab | |
15 | 15 | another by being thrown; | |
16 | 16 | (C) dagger, including but not limited to a dirk, | |
17 | 17 | stiletto, and poniard; | |
18 | 18 | (D) [bowie knife; | |
19 | 19 | [(E)] sword; or | |
20 | 20 | (E) [(F)] spear. | |
21 | 21 | SECTION 2. Section 46.15(e), Penal Code, is amended to read | |
22 | 22 | as follows: | |
23 | 23 | (e) The provisions of Section 46.02 prohibiting the | |
24 | 24 | carrying of an illegal knife do not apply to an individual carrying | |
25 | 25 | a [bowie knife or a] sword used in a historical demonstration or in | |
26 | 26 | a ceremony in which the [knife or] sword is significant to the | |
27 | 27 | performance of the ceremony. | |
28 | 28 | SECTION 3. The change in law made by this Act applies only | |
29 | 29 | to an offense committed on or after the effective date of this Act. | |
30 | 30 | An offense committed before the effective date of this Act is | |
31 | 31 | governed by the law in effect on the date the offense was committed, | |
32 | 32 | and the former law is continued in effect for that purpose. For | |
33 | 33 | purposes of this section, an offense was committed before the | |
34 | 34 | effective date of this Act if any element of the offense occurred | |
35 | 35 | before that date. | |
36 | 36 | SECTION 4. This Act takes effect September 1, 2015. |
