| 7 | 7 | | relating to the balance maintained in a school district's general |

| 8 | 8 | | fund and associated requirements regarding the general fund. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 39, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 39.0822 to read as follows: |
|---|
| 12 | 12 | | Sec. 39.0822. GENERAL FUND REQUIREMENTS. (a) The |
|---|
| 13 | 13 | | commissioner by rule shall require each school district to: |
|---|
| 14 | 14 | | (1) maintain a minimum balance in the district's |
|---|
| 15 | 15 | | general fund; and |
|---|
| 16 | 16 | | (2) publicly report each year the district's intended |
|---|
| 17 | 17 | | use of general fund balances that exceed a specified percentage of |
|---|
| 18 | 18 | | the district's annual operating expenditures. |
|---|
| 19 | 19 | | (b) For purposes of Subsection (a)(1), the commissioner may |
|---|
| 20 | 20 | | express the balance required as a percentage of a district's annual |
|---|
| 21 | 21 | | operating expenditures or in another manner considered appropriate |
|---|
| 22 | 22 | | by the commissioner. The commissioner may impose variable balance |
|---|
| 23 | 23 | | requirements for school districts based on relevant school district |
|---|
| 24 | 24 | | characteristics. |
|---|
| 25 | 25 | | (c) Each school district board of trustees must adopt a |
|---|
| 26 | 26 | | policy regarding the operation of the general fund and the minimum |
|---|
| 27 | 27 | | balance to be maintained by the district. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2015. |
