9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter I, Chapter 51, Education Code, is | |
11 | 11 | amended by adding Section 51.456 to read as follows: | |
12 | 12 | Sec. 51.456. ELECTRONIC TEXTBOOKS REQUIRED. (a) Not later | |
13 | 13 | than January 1, 2020, a textbook publisher who offers textbooks for | |
14 | 14 | sale at a college bookstore shall, to the extent practicable, make | |
15 | 15 | the textbooks available for sale wholly or partly in an electronic | |
16 | 16 | format. The electronic version of any textbook must contain the | |
17 | 17 | same content as the printed version and may be copy-protected. | |
18 | 18 | (b) This section does not authorize any use of a textbook or | |
19 | 19 | other instructional materials that would constitute an | |
20 | 20 | infringement of copyright under the Copyright Act of 1976 (17 | |
21 | 21 | U.S.C. Section 101 et seq.). | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2015. |
