77 relating to requiring certain textbook publishers to offer
88 electronic textbooks.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter I, Chapter 51, Education Code, is
1111 amended by adding Section 51.456 to read as follows:
1212 Sec. 51.456. ELECTRONIC TEXTBOOKS REQUIRED. (a) Not later
1313 than January 1, 2020, a textbook publisher who offers textbooks for
1414 sale at a college bookstore shall, to the extent practicable, make
1515 the textbooks available for sale wholly or partly in an electronic
1616 format. The electronic version of any textbook must contain the
1717 same content as the printed version and may be copy-protected.
1818 (b) This section does not authorize any use of a textbook or
1919 other instructional materials that would constitute an
2020 infringement of copyright under the Copyright Act of 1976 (17
2121 U.S.C. Section 101 et seq.).
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2015.
