66 AN ACT
77 relating to the operation of a neighborhood electric vehicle.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 551.301, Transportation Code, is amended
1010 to read as follows:
1111 Sec. 551.301. DEFINITION. In this subchapter,
1212 "neighborhood electric vehicle" means a vehicle used for
1313 recreational or commercial purposes that can attain a maximum speed
1414 of 35 miles per hour on a paved level surface and otherwise complies
1515 with Federal Motor Vehicle Safety Standard 500 (49 C.F.R. Section
1616 571.500).
1717 SECTION 2. Section 551.304(a), Transportation Code, is
1818 amended to read as follows:
1919 (a) An operator may operate a neighborhood electric
2020 vehicle:
2121 (1) in a master planned community:
2222 (A) that has in place a uniform set of
2323 restrictive covenants; and
2424 (B) for which a county or municipality has
2525 approved a plat;
2626 (2) on a public or private beach; or
2727 (3) on a public highway for which the posted speed
2828 limit is not more than 35 miles per hour[, if the neighborhood
2929 electric vehicle is operated:
3030 [(A) during the daytime; and
3131 [(B) not more than two miles from the location
3232 where the neighborhood electric vehicle is usually parked and for
3333 transportation to or from a golf course].
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2015.
