| 22 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 23 | 8 | | SECTION 1. Section 16.0121(g), Water Code, is amended to |
|---|
| 24 | 9 | | read as follows: |
|---|
| 25 | 10 | | (g) A retail public utility providing potable water that |
|---|
| 26 | 11 | | receives from the board financial assistance shall use a portion of |
|---|
| 27 | 12 | | that financial assistance, or any additional financial assistance |
|---|
| 28 | 13 | | provided by the board for the purpose described by this subsection, |
|---|
| 29 | 14 | | to mitigate the utility's system water loss if, based on a water |
|---|
| 30 | 15 | | audit filed by the utility under this section, the water loss meets |
|---|
| 31 | 16 | | or exceeds the threshold established by board rule. On the request |
|---|
| 32 | 17 | | of a retail public utility, the board may waive the requirements of |
|---|
| 33 | 18 | | this subsection if the board finds that the utility is |
|---|
| 34 | 19 | | satisfactorily addressing the utility's system water loss. |
|---|
| 35 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 24 | | Act takes effect September 1, 2015. |
