66 AN ACT
77 relating to an electronic application for voter registration and a
88 ballot to be voted by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1111 amended by adding Section 13.009 to read as follows:
1212 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1313 secretary of state shall implement a program to allow a person to
1414 complete a voter registration application over the Internet from
1515 the official website of this state. The websites of the secretary
1616 of state and the Department of Public Safety must also provide a
1717 link to the location of the application on the official website of
1818 this state.
1919 (b) An applicant for electronic voter registration who has
2020 an unexpired driver's license or personal identification card
2121 issued in this state must:
2222 (1) attest to the truth of the information provided on
2323 the application by affirmatively accepting the information as true;
2424 and
2525 (2) affirmatively consent to the use of the signature
2626 on the applicant's driver's license or personal identification card
2727 for voter registration purposes.
2828 (c) An applicant for electronic voter registration who does
2929 not have an unexpired driver's license or personal identification
3030 card issued in this state must:
3131 (1) attest to the truth of the information provided on
3232 the application by affirmatively accepting the information as true;
3333 and
3434 (2) print a registration application from the website
3535 the applicant is using to register, sign the application, and mail
3636 it to the registrar.
3737 (d) The program must allow an applicant to:
3838 (1) indicate whether the applicant is eligible for a
3939 ballot to be voted by mail; and
4040 (2) if the applicant is eligible, complete an
4141 application for a ballot to be voted by mail as part of the
4242 registration process.
4343 (e) For each application submitted under Subsection (b),
4444 the program shall:
4545 (1) require that a digital copy of the applicant's
4646 signature be obtained from the Department of Public Safety; and
4747 (2) compare the information provided by the applicant
4848 against Department of Public Safety records.
4949 (f) For each application submitted under Subsection (c),
5050 the program shall provide the applicant with:
5151 (1) a registration application that the applicant can
5252 print from the registration website, sign, and mail to the
5353 registrar as required under Subsection (c)(2); and
5454 (2) information about how the applicant can obtain a
5555 driver's license or personal identification card from the
5656 Department of Public Safety.
5757 (g) If the information submitted by an applicant under
5858 Subsection (b) does not match Department of Public Safety records,
5959 the program shall:
6060 (1) notify the applicant that the application cannot
6161 be processed electronically; and
6262 (2) advise the applicant to print an application and
6363 submit it to the voter registrar of the county in which the
6464 applicant resides by mail or personal delivery.
6565 (h) If the information submitted by an applicant under
6666 Subsection (b) matches Department of Public Safety records, the
6767 program shall forward the application to the registrar of the
6868 county in which the applicant states that the applicant resides.
6969 (i) On receipt of an application under Subsection (h), the
7070 registrar shall review the application in accordance with Section
7171 13.071.
7272 (j) The program must allow an applicant, at any time, to
7373 print the application for completion and submission to the voter
7474 registrar by mail or personal delivery.
7575 (k) An application electronically submitted under this
7676 section is considered for all purposes as an application submitted
7777 by mail under this title.
7878 (l) The secretary of state shall adopt rules as necessary to
7979 implement this section, including rules to:
8080 (1) provide for additional security measures
8181 necessary to ensure the accuracy and integrity of applications
8282 submitted electronically; and
8383 (2) ensure that an application for a ballot to be voted
8484 by mail that is submitted under this section is forwarded as soon as
8585 possible to the appropriate early voting clerk.
8686 (m) The rules adopted under Subsection (l) must require
8787 that:
8888 (1) the Internet website through which a person may
8989 complete a voter registration application include a description of
9090 the offense described by Section 13.007 in a conspicuous location
9191 on the website near the place where the person begins or submits the
9292 application; and
9393 (2) the state electronic Internet portal project be
9494 used to authenticate the identity of a person who submits an
9595 application electronically under this section.
9696 SECTION 2. Section 84.007(b), Election Code, is amended to
9797 read as follows:
9898 (b) An application must be submitted to the early voting
9999 clerk by:
100100 (1) mail;
101101 (2) common or contract carrier; [or]
102102 (3) telephonic facsimile machine, if a machine is
103103 available in the clerk's office; or
104104 (4) electronic means under Section 13.009.
105105 SECTION 3. This Act takes effect September 1, 2015.
