55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the exemption of school district property from certain
88 infrastructure fees charged for the control of excess water or
99 storm water.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 580.003, Local Government Code, as
1212 redesignated by Chapter 885 (H.B. 2278), Acts of the 80th
1313 Legislature, Regular Session, 2007, and amended by Chapters 1356
1414 (H.B. 462) and 1430 (S.B. 3), Acts of the 80th Legislature, Regular
1515 Session, 2007, is reenacted and amended to read as follows:
1616 Sec. 580.003. EXEMPTIONS OF CERTAIN PROPERTY FROM
1717 INFRASTRUCTURE FEES. (a) Except as provided by Subsection (b), no
1818 county, municipality, or utility district may collect from a state
1919 agency, [or a] public or private institution of higher education,
2020 or school district any fee charged for the development or
2121 maintenance of programs or facilities for the control of excess
2222 water or storm water.
2323 (b) A municipality with a population of 25,000 or less and
2424 through which the Bosque River runs may collect from a state agency,
2525 [or] public institution of higher education, or school district a
2626 fee charged for the development or maintenance of programs or [of]
2727 facilities for the control of excess water or storm water.
2828 SECTION 2. The change in law made by this Act does not
2929 affect fees imposed before the effective date of this Act, and the
3030 law in effect before that date is continued in effect for the
3131 purpose of the liability for and collection of those fees.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2015.
