55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the elimination of the statute of limitations for the
88 offenses of sexual assault and aggravated sexual assault.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 12.01, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1313 felony indictments may be presented within these limits, and not
1414 afterward:
1515 (1) no limitation:
1616 (A) murder and manslaughter;
1717 (B) sexual assault [under Section 22.011(a)(2),
1818 Penal Code,] or aggravated sexual assault [under Section
1919 22.021(a)(1)(B), Penal Code;
2020 [(C) sexual assault, if during the investigation
2121 of the offense biological matter is collected and subjected to
2222 forensic DNA testing and the testing results show that the matter
2323 does not match the victim or any other person whose identity is
2424 readily ascertained];
2525 (C) [(D)] continuous sexual abuse of young child
2626 or children under Section 21.02, Penal Code;
2727 (D) [(E)] indecency with a child under Section
2828 21.11, Penal Code;
2929 (E) [(F)] an offense involving leaving the scene
3030 of an accident under Section 550.021, Transportation Code, if the
3131 accident resulted in the death of a person;
3232 (F) [(G)] trafficking of persons under Section
3333 20A.02(a)(7) or (8), Penal Code; or
3434 (G) [(H)] continuous trafficking of persons
3535 under Section 20A.03, Penal Code;
3636 (2) ten years from the date of the commission of the
3737 offense:
3838 (A) theft of any estate, real, personal or mixed,
3939 by an executor, administrator, guardian or trustee, with intent to
4040 defraud any creditor, heir, legatee, ward, distributee,
4141 beneficiary or settlor of a trust interested in such estate;
4242 (B) theft by a public servant of government
4343 property over which he exercises control in his official capacity;
4444 (C) forgery or the uttering, using or passing of
4545 forged instruments;
4646 (D) injury to an elderly or disabled individual
4747 punishable as a felony of the first degree under Section 22.04,
4848 Penal Code;
4949 (E) [sexual assault, except as provided by
5050 Subdivision (1);
5151 [(F)] arson;
5252 (F) [(G)] trafficking of persons under Section
5353 20A.02(a)(1), (2), (3), or (4), Penal Code; or
5454 (G) [(H)] compelling prostitution under Section
5555 43.05(a)(1), Penal Code;
5656 (3) seven years from the date of the commission of the
5757 offense:
5858 (A) misapplication of fiduciary property or
5959 property of a financial institution;
6060 (B) securing execution of document by deception;
6161 (C) a felony violation under Chapter 162, Tax
6262 Code;
6363 (D) false statement to obtain property or credit
6464 under Section 32.32, Penal Code;
6565 (E) money laundering;
6666 (F) credit card or debit card abuse under Section
6767 32.31, Penal Code;
6868 (G) fraudulent use or possession of identifying
6969 information under Section 32.51, Penal Code;
7070 (H) Medicaid fraud under Section 35A.02, Penal
7171 Code; or
7272 (I) bigamy under Section 25.01, Penal Code,
7373 except as provided by Subdivision (6);
7474 (4) five years from the date of the commission of the
7575 offense:
7676 (A) theft or robbery;
7777 (B) except as provided by Subdivision (5),
7878 kidnapping or burglary;
7979 (C) injury to an elderly or disabled individual
8080 that is not punishable as a felony of the first degree under Section
8181 22.04, Penal Code;
8282 (D) abandoning or endangering a child; or
8383 (E) insurance fraud;
8484 (5) if the investigation of the offense shows that the
8585 victim is younger than 17 years of age at the time the offense is
8686 committed, 20 years from the 18th birthday of the victim of one of
8787 the following offenses:
8888 (A) sexual performance by a child under Section
8989 43.25, Penal Code;
9090 (B) aggravated kidnapping under Section
9191 20.04(a)(4), Penal Code, if the defendant committed the offense
9292 with the intent to violate or abuse the victim sexually; or
9393 (C) burglary under Section 30.02, Penal Code, if
9494 the offense is punishable under Subsection (d) of that section and
9595 the defendant committed the offense with the intent to commit an
9696 offense described by Subdivision (1)(B) or (C) [(D)] of this
9797 article or Paragraph (B) of this subdivision;
9898 (6) ten years from the 18th birthday of the victim of
9999 the offense:
100100 (A) trafficking of persons under Section
101101 20A.02(a)(5) or (6), Penal Code;
102102 (B) injury to a child under Section 22.04, Penal
103103 Code;
104104 (C) compelling prostitution under Section
105105 43.05(a)(2), Penal Code; or
106106 (D) bigamy under Section 25.01, Penal Code, if
107107 the investigation of the offense shows that the person, other than
108108 the legal spouse of the defendant, whom the defendant marries or
109109 purports to marry or with whom the defendant lives under the
110110 appearance of being married is younger than 18 years of age at the
111111 time the offense is committed; or
112112 (7) three years from the date of the commission of the
113113 offense: all other felonies.
114114 SECTION 2. The change in law made by this Act does not apply
115115 to an offense if the prosecution of that offense becomes barred by
116116 limitation before the effective date of this Act. The prosecution
117117 of that offense remains barred as if this Act had not taken effect.
118118 SECTION 3. This Act takes effect September 1, 2015.
