114 AN ACT
125 relating to the compensation and per diem compensation of emergency
136 services commissioners in certain counties.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Subchapter C, Chapter 775, Health and Safety
169 Code, is amended by adding Section 775.0381 to read as follows:
1710 Sec. 775.0381. COMPENSATION IN CERTAIN POPULOUS COUNTIES.
1811 (a) This section applies only to an emergency services
1912 commissioner of a district located wholly in a county with a
2013 population of more than three million.
2114 (b) Notwithstanding Section 775.038(a), except as provided
2215 by Subsection (c), an emergency services commissioner is entitled
2316 to receive compensation of not more than $150 per day for each day
2417 the commissioner actually spends performing the duties of a
2518 commissioner. Compensation may not exceed $7,200 per year.
2619 Commissioners may be reimbursed for reasonable and necessary
2720 expenses incurred in performing official duties.
2821 (c) Notwithstanding Section 775.038(b), instead of
2922 compensation under Subsection (b), a commissioner may elect to
3023 receive per diem compensation of $150 for each day the commissioner
3124 actually spends performing the duties of a commissioner. A
3225 commissioner who receives per diem compensation may not be
3326 reimbursed for reasonable and necessary expenses. Per diem
3427 payments may not exceed $7,200 per year.
3528 SECTION 2. The changes in law made by this Act apply only to
3629 the payment of compensation and per diem compensation of an
3730 emergency services commissioner for the performance of duties on or
3831 after the effective date of this Act. The payment of compensation or
3932 per diem compensation before the effective date of this Act is
4033 governed by the law in effect when the duty is performed, and the
4134 former law is continued in effect for that purpose.
4235 SECTION 3. This Act takes effect immediately if it receives
4336 a vote of two-thirds of all the members elected to each house, as
4437 provided by Section 39, Article III, Texas Constitution. If this
4538 Act does not receive the vote necessary for immediate effect, this
4639 Act takes effect September 1, 2015.
