11	4		AN ACT
12	5		relating to the compensation and per diem compensation of emergency
13	6		services commissioners in certain counties.
14	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	8		SECTION 1. Subchapter C, Chapter 775, Health and Safety
16	9		Code, is amended by adding Section 775.0381 to read as follows:
17	10		Sec. 775.0381. COMPENSATION IN CERTAIN POPULOUS COUNTIES.
18	11		(a) This section applies only to an emergency services
19	12		commissioner of a district located wholly in a county with a
20	13		population of more than three million.
21	14		(b) Notwithstanding Section 775.038(a), except as provided
22	15		by Subsection (c), an emergency services commissioner is entitled
23	16		to receive compensation of not more than $150 per day for each day
24	17		the commissioner actually spends performing the duties of a
25	18		commissioner. Compensation may not exceed $7,200 per year.
26	19		Commissioners may be reimbursed for reasonable and necessary
27	20		expenses incurred in performing official duties.
28	21		(c) Notwithstanding Section 775.038(b), instead of
29	22		compensation under Subsection (b), a commissioner may elect to
30	23		receive per diem compensation of $150 for each day the commissioner
31	24		actually spends performing the duties of a commissioner. A
32	25		commissioner who receives per diem compensation may not be
33	26		reimbursed for reasonable and necessary expenses. Per diem
34	27		payments may not exceed $7,200 per year.
35	28		SECTION 2. The changes in law made by this Act apply only to
36	29		the payment of compensation and per diem compensation of an
37	30		emergency services commissioner for the performance of duties on or
38	31		after the effective date of this Act. The payment of compensation or
39	32		per diem compensation before the effective date of this Act is
40	33		governed by the law in effect when the duty is performed, and the
41	34		former law is continued in effect for that purpose.
42	35		SECTION 3. This Act takes effect immediately if it receives
43	36		a vote of two-thirds of all the members elected to each house, as
44	37		provided by Section 39, Article III, Texas Constitution. If this
45	38		Act does not receive the vote necessary for immediate effect, this
46	39		Act takes effect September 1, 2015.
