55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the offense of manslaughter; increasing the penalty for
88 certain offenders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 19.04(b), Penal Code, is amended to read
1111 as follows:
1212 (b) An offense under this section is a felony of the second
1313 degree, except that an offense is a felony of the first degree if:
1414 (1) the actor delivered a controlled substance to the
1515 individual in violation of Chapter 481, Health and Safety Code;
1616 (2) the individual consumed the controlled substance
1717 without altering the substance; and
1818 (3) the individual's death resulted from the
1919 consumption of the controlled substance.
2020 SECTION 2. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 governed by the law in effect on the date the offense was committed,
2424 and the former law is continued in effect for that purpose. For
2525 purposes of this section, an offense was committed before the
2626 effective date of this Act if any element of the offense was
2727 committed before that date.
2828 SECTION 3. This Act takes effect September 1, 2015.
