|---|
| 8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 9 | 9 | | SECTION 1. Sections 49-g(c), (c-1), and (c-2), Article III, |
|---|
| 10 | 10 | | Texas Constitution, are amended to read as follows: |
|---|
| 11 | 11 | | (c) Not later than the 90th day of each fiscal year, the |
|---|
| 12 | 12 | | comptroller of public accounts shall transfer from the general |
|---|
| 13 | 13 | | revenue fund to the economic stabilization fund, the Texas rail |
|---|
| 14 | 14 | | relocation and improvement fund, and the state highway fund the sum |
|---|
| 15 | 15 | | of the amounts described by Subsections (d) and (e) of this section, |
|---|
| 16 | 16 | | to be allocated as provided by Subsections (c-1) and (c-2) of this |
|---|
| 17 | 17 | | section. However, if necessary and notwithstanding the allocations |
|---|
| 18 | 18 | | prescribed by Subsections (c-1) and (c-2) of this section, the |
|---|
| 19 | 19 | | comptroller shall reduce proportionately the amounts described by |
|---|
| 20 | 20 | | Subsections (d) and (e) of this section to be transferred and |
|---|
| 21 | 21 | | allocated to the economic stabilization fund to prevent the amount |
|---|
| 22 | 22 | | in that fund from exceeding the limit in effect for that biennium |
|---|
| 23 | 23 | | under Subsection (g) of this section. Revenue transferred to the |
|---|
| 24 | 24 | | state highway fund under this subsection may be used only for |
|---|
| 25 | 25 | | constructing, maintaining, and acquiring rights-of-way for public |
|---|
| 26 | 26 | | roadways other than toll roads. |
|---|
| 27 | 27 | | (c-1) Of the sum of the amounts described by Subsections (d) |
|---|
| 28 | 28 | | and (e) of this section and required to be transferred from the |
|---|
| 29 | 29 | | general revenue fund under Subsection (c) of this section, the |
|---|
| 30 | 30 | | comptroller shall allocate 50 percent [one-half] to the economic |
|---|
| 31 | 31 | | stabilization fund, and 50 percent to the state highway fund minus |
|---|
| 32 | 32 | | $100 million to be directed to the Texas rail relocation and |
|---|
| 33 | 33 | | improvement fund, except as provided by Subsection (c-2) of this |
|---|
| 34 | 34 | | section. |
|---|
| 35 | 35 | | (c-2) The legislature by general law shall provide for a |
|---|
| 36 | 36 | | procedure by which the allocation of the sum of the amounts |
|---|
| 37 | 37 | | described by Subsections (d) and (e) of this section may be adjusted |
|---|
| 38 | 38 | | to provide for a transfer to the economic stabilization fund of an |
|---|
| 39 | 39 | | amount greater than the allocation provided for under Subsection |
|---|
| 40 | 40 | | (c-1) of this section with the remainder of that sum, if any, |
|---|
| 41 | 41 | | allocated for transfer to the Texas rail relocation and improvement |
|---|
| 42 | 42 | | fund and the state highway fund. The allocation made as provided by |
|---|
| 43 | 43 | | that general law is binding on the comptroller for the purposes of |
|---|
| 44 | 44 | | the transfers required by Subsection (c) of this section. |
|---|
| 45 | 45 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 46 | 46 | | submitted to the voters at an election to be held November 3, 2015. |
|---|
| 47 | 47 | | The ballot shall be printed to permit voting for or against the |
|---|
| 48 | 48 | | proposition: "The constitutional amendment providing for the |
|---|
| 49 | 49 | | transfer of certain general revenue to the Texas rail relocation |
|---|
| 50 | 50 | | and improvement fund." |
