55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing certain elected
77 county or district officeholders to become candidates for a
88 countywide office of the same county without automatically
99 resigning from the office already being held.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 65(b), Article XVI, Texas Constitution,
1212 is amended to read as follows:
1313 (b) If any of the officers named herein shall announce their
1414 candidacy, or shall in fact become a candidate, in any General,
1515 Special or Primary Election, for any office of profit or trust under
1616 the laws of this State or the United States other than the office
1717 then held or an office of the same county elected by the voters of
1818 the entire county, at any time when the unexpired term of the office
1919 then held shall exceed one year and 30 days, such announcement or
2020 such candidacy shall constitute an automatic resignation of the
2121 office then held, and the vacancy thereby created shall be filled
2222 pursuant to law in the same manner as other vacancies for such
2323 office are filled.
2424 SECTION 2. This proposed constitutional amendment shall be
2525 submitted to the voters at an election to be held November 3, 2015.
2626 The ballot shall be printed to provide for voting for or against the
2727 proposition: "The constitutional amendment authorizing certain
2828 elected county or district officeholders to become candidates for a
2929 countywide office of the same county without automatically
3030 resigning from the office already being held."
