55 A JOINT RESOLUTION
66 proposing a constitutional amendment relating to the exclusive
77 legislative duty to support and maintain an efficient system of
88 public schools.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1, Article VII, Texas Constitution, is
1111 amended to read as follows:
1212 Sec. 1. A general diffusion of knowledge being essential to
1313 the preservation of the liberties and rights of the people, it shall
1414 be the duty of the Legislature of the State to establish and make
1515 suitable provision for the support and maintenance of an efficient
1616 system of public free schools. The duty imposed by this section is
1717 the sole prerogative of the Legislature. Notwithstanding the rights
1818 and duties imposed by Article V of this constitution, the judicial
1919 branch of the State has no authority to interfere or issue a
2020 judgment or opinion on the actions of the Legislature implementing
2121 this section.
2222 SECTION 2. This proposed constitutional amendment shall be
2323 submitted to the voters at an election to be held November 3, 2015.
2424 The ballot shall be printed to permit voting for or against the
2525 proposition: "The constitutional amendment providing for the
2626 exclusive legislative duty to support and maintain an efficient
2727 system of public free schools."
