9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 1, Article VII, Texas Constitution, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Sec. 1. A general diffusion of knowledge being essential to | |
13 | 13 | the preservation of the liberties and rights of the people, it shall | |
14 | 14 | be the duty of the Legislature of the State to establish and make | |
15 | 15 | suitable provision for the support and maintenance of an efficient | |
16 | 16 | system of public free schools. The duty imposed by this section is | |
17 | 17 | the sole prerogative of the Legislature. Notwithstanding the rights | |
18 | 18 | and duties imposed by Article V of this constitution, the judicial | |
19 | 19 | branch of the State has no authority to interfere or issue a | |
20 | 20 | judgment or opinion on the actions of the Legislature implementing | |
21 | 21 | this section. | |
22 | 22 | SECTION 2. This proposed constitutional amendment shall be | |
23 | 23 | submitted to the voters at an election to be held November 3, 2015. | |
24 | 24 | The ballot shall be printed to permit voting for or against the | |
25 | 25 | proposition: "The constitutional amendment providing for the | |
26 | 26 | exclusive legislative duty to support and maintain an efficient | |
27 | 27 | system of public free schools." |
