55 A JOINT RESOLUTION
66 proposing a constitutional amendment to dedicate net revenue from
77 the state lottery to support educational programs that benefit
88 classroom teaching in the state's public schools and to prohibit
99 certain lottery advertisements and promotions.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 47, Article III, Texas Constitution, is
1212 amended by amending Subsection (e) and adding Subsection (f) to
1313 read as follows:
1414 (e) The Legislature by general law may authorize the State
1515 to operate lotteries and may authorize the State to enter into a
1616 contract with one or more legal entities that will operate
1717 lotteries on behalf of the State. All money received by the State
1818 from the operation of lotteries, other than amounts paid for
1919 administrative costs, unclaimed lottery prizes, and amounts paid
2020 for lottery prizes, is dedicated to and may be expended only for the
2121 enrichment of educational programs of the State's public primary
2222 and secondary schools and only for items that directly benefit
2323 classroom teaching, including teacher compensation and the
2424 acquisition of textbooks and educational supplies, materials,
2525 equipment, and services.
2626 (f) An advertisement or promotion sponsored by the State or
2727 a holder of a license issued by the State and related to the
2828 operation of a lottery authorized by Subsection (e) of this section
2929 may not encourage or attempt to influence a person to purchase a
3030 lottery ticket by stating that revenue generated from the sale of
3131 the ticket will be used to support or provide additional funds to
3232 the State's public primary or secondary schools.
3333 SECTION 2. This proposed constitutional amendment shall be
3434 submitted to the voters at an election to be held November 3, 2015.
3535 The ballot shall be printed to permit voting for or against the
3636 proposition: "The constitutional amendment to dedicate net revenue
3737 from the state lottery to support educational programs that benefit
3838 classroom teaching in the state's public schools and to prohibit
3939 advertisements and promotions that state the revenue generated by
4040 the sale of lottery tickets is used to financially assist public
4141 schools."
