66 AN ACT
77 relating to the use of sales tax revenue collected under certain
88 contracts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter G, Chapter 54, Water Code, is amended
1111 by adding Section 54.605 to read as follows:
1212 Sec. 54.605. USE OF SALES TAX REVENUE UNDER CERTAIN
1313 CONTRACTS. (a) This section applies only to:
1414 (1) a district located in a county with a population of
1515 550,000 or more and included in:
1616 (A) the Harris-Galveston Subsidence District; or
1717 (B) the Fort Bend Subsidence District;
1818 (2) a municipality with a population of 1,000,000 or
1919 more that is included in the Harris-Galveston Subsidence District;
2020 and
2121 (3) money received by a municipality under Chapter
2222 321, Tax Code, from sales or uses consummated within the district, a
2323 percentage of which is distributed to the district by the
2424 municipality under the terms of a contract with the municipality,
2525 including a strategic partnership agreement authorized by Section
2626 43.0751, Local Government Code.
2727 (b) Except as provided by Subsection (c), the municipality
2828 and the district must each use at least 50 percent of the money
2929 described by Subsection (a)(3) for drainage or road projects that:
3030 (1) are located or conducted within the district or
3131 within five miles of the district's boundary;
3232 (2) benefit residents of the district;
3333 (3) are consistent with the major thoroughfare plan of
3434 the county in which the project is located; and
3535 (4) are not required to be undertaken by the
3636 municipality, the district, or another person under applicable
3737 platting regulations of the county in which the project is located.
3838 (c) This section applies to a contract or strategic
3939 partnership agreement entered into before September 1, 2015, only
4040 to the extent that the provisions of Subsection (b) do not impair
4141 obligations under the provisions of the contract or agreement.
4242 SECTION 2. This Act takes effect September 1, 2015.
