108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1210 Code, is amended by adding Chapter 7910 to read as follows:
1311 CHAPTER 7910. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 540
1412 SUBCHAPTER A. GENERAL PROVISIONS
1513 Sec. 7910.001. DEFINITIONS. In this chapter:
1614 (1) "Board" means the district's board of directors.
1715 (2) "Commission" means the Texas Commission on
1816 Environmental Quality.
1917 (3) "Director" means a board member.
2018 (4) "District" means the Harris County Municipal
2119 Utility District No. 540.
2220 Sec. 7910.002. NATURE OF DISTRICT. The district is a
2321 municipal utility district created under Section 59, Article XVI,
2422 Texas Constitution.
2523 Sec. 7910.003. CONFIRMATION AND DIRECTORS' ELECTION
2624 REQUIRED. The temporary directors shall hold an election to
2725 confirm the creation of the district and to elect five permanent
2826 directors as provided by Section 49.102, Water Code.
2927 Sec. 7910.004. CONSENT OF MUNICIPALITY REQUIRED. The
3028 temporary directors may not hold an election under Section 7910.003
3129 until each municipality in whose corporate limits or
3230 extraterritorial jurisdiction the district is located has
3331 consented by ordinance or resolution to the creation of the
3432 district and to the inclusion of land in the district.
3533 Sec. 7910.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3634 (a) The district is created to serve a public purpose and benefit.
3735 (b) The district is created to accomplish the purposes of:
3836 (1) a municipal utility district as provided by
3937 general law and Section 59, Article XVI, Texas Constitution; and
4038 (2) Section 52, Article III, Texas Constitution, that
4139 relate to the construction, acquisition, improvement, operation,
4240 or maintenance of macadamized, graveled, or paved roads, or
4341 improvements, including storm drainage, in aid of those roads.
4442 Sec. 7910.006. INITIAL DISTRICT TERRITORY. (a) The
4543 district is initially composed of the territory described by
4644 Section 2 of the Act enacting this chapter.
4745 (b) The boundaries and field notes contained in Section 2 of
4846 the Act enacting this chapter form a closure. A mistake made in the
4947 field notes or in copying the field notes in the legislative process
5048 does not affect the district's:
5149 (1) organization, existence, or validity;
5250 (2) right to issue any type of bond for the purposes
5351 for which the district is created or to pay the principal of and
5452 interest on a bond;
5553 (3) right to impose a tax; or
5654 (4) legality or operation.
5755 SUBCHAPTER B. BOARD OF DIRECTORS
5856 Sec. 7910.051. GOVERNING BODY; TERMS. (a) The district is
5957 governed by a board of five elected directors.
6058 (b) Except as provided by Section 7910.052, directors serve
6159 staggered four-year terms.
6260 Sec. 7910.052. TEMPORARY DIRECTORS. (a) On or after the
6361 effective date of the Act enacting this chapter, the owner or owners
6462 of a majority of the assessed value of the real property in the
6563 district may submit a petition to the commission requesting that
6664 the commission appoint as temporary directors the five persons
6765 named in the petition. The commission shall appoint as temporary
6866 directors the five persons named in the petition.
6967 (b) Temporary directors serve until the earlier of:
7068 (1) the date permanent directors are elected under
7169 Section 7910.003; or
7270 (2) the fourth anniversary of the effective date of
7371 the Act enacting this chapter.
7472 (c) If permanent directors have not been elected under
7573 Section 7910.003 and the terms of the temporary directors have
7674 expired, successor temporary directors shall be appointed or
7775 reappointed as provided by Subsection (d) to serve terms that
7876 expire on the earlier of:
7977 (1) the date permanent directors are elected under
8078 Section 7910.003; or
8179 (2) the fourth anniversary of the date of the
8280 appointment or reappointment.
8381 (d) If Subsection (c) applies, the owner or owners of a
8482 majority of the assessed value of the real property in the district
8583 may submit a petition to the commission requesting that the
8684 commission appoint as successor temporary directors the five
8785 persons named in the petition. The commission shall appoint as
8886 successor temporary directors the five persons named in the
8987 petition.
9088 SUBCHAPTER C. POWERS AND DUTIES
9189 Sec. 7910.101. GENERAL POWERS AND DUTIES. The district has
9290 the powers and duties necessary to accomplish the purposes for
9391 which the district is created.
9492 Sec. 7910.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9593 DUTIES. The district has the powers and duties provided by the
9694 general law of this state, including Chapters 49 and 54, Water Code,
9795 applicable to municipal utility districts created under Section 59,
9896 Article XVI, Texas Constitution.
9997 Sec. 7910.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10098 52, Article III, Texas Constitution, the district may design,
10199 acquire, construct, finance, issue bonds for, improve, operate,
102100 maintain, and convey to this state, a county, or a municipality for
103101 operation and maintenance macadamized, graveled, or paved roads, or
104102 improvements, including storm drainage, in aid of those roads.
105103 Sec. 7910.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
106104 road project must meet all applicable construction standards,
107105 zoning and subdivision requirements, and regulations of each
108106 municipality in whose corporate limits or extraterritorial
109107 jurisdiction the road project is located.
110108 (b) If a road project is not located in the corporate limits
111109 or extraterritorial jurisdiction of a municipality, the road
112110 project must meet all applicable construction standards,
113111 subdivision requirements, and regulations of each county in which
114112 the road project is located.
115113 (c) If the state will maintain and operate the road, the
116114 Texas Transportation Commission must approve the plans and
117115 specifications of the road project.
118116 Sec. 7910.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
119117 OR RESOLUTION. The district shall comply with all applicable
120118 requirements of any ordinance or resolution that is adopted under
121119 Section 54.016 or 54.0165, Water Code, and that consents to the
122120 creation of the district or to the inclusion of land in the
123121 district.
124122 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
125123 Sec. 7910.151. ELECTIONS REGARDING TAXES OR BONDS.
126124 (a) The district may issue, without an election, bonds and other
127125 obligations secured by:
128126 (1) revenue other than ad valorem taxes; or
129127 (2) contract payments described by Section 7910.153.
130128 (b) The district must hold an election in the manner
131129 provided by Chapters 49 and 54, Water Code, to obtain voter approval
132130 before the district may impose an ad valorem tax or issue bonds
133131 payable from ad valorem taxes.
134132 (c) The district may not issue bonds payable from ad valorem
135133 taxes to finance a road project unless the issuance is approved by a
136134 vote of a two-thirds majority of the district voters voting at an
137135 election held for that purpose.
138136 Sec. 7910.152. OPERATION AND MAINTENANCE TAX. (a) If
139137 authorized at an election held under Section 7910.151, the district
140138 may impose an operation and maintenance tax on taxable property in
141139 the district in accordance with Section 49.107, Water Code.
142140 (b) The board shall determine the tax rate. The rate may not
143141 exceed the rate approved at the election.
144142 Sec. 7910.153. CONTRACT TAXES. (a) In accordance with
145143 Section 49.108, Water Code, the district may impose a tax other than
146144 an operation and maintenance tax and use the revenue derived from
147145 the tax to make payments under a contract after the provisions of
148146 the contract have been approved by a majority of the district voters
149147 voting at an election held for that purpose.
150148 (b) A contract approved by the district voters may contain a
151149 provision stating that the contract may be modified or amended by
152150 the board without further voter approval.
153151 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
154152 Sec. 7910.201. AUTHORITY TO ISSUE BONDS AND OTHER
155153 OBLIGATIONS. The district may issue bonds or other obligations
156154 payable wholly or partly from ad valorem taxes, impact fees,
157155 revenue, contract payments, grants, or other district money, or any
158156 combination of those sources, to pay for any authorized district
159157 purpose.
160158 Sec. 7910.202. TAXES FOR BONDS. At the time the district
161159 issues bonds payable wholly or partly from ad valorem taxes, the
162160 board shall provide for the annual imposition of a continuing
163161 direct ad valorem tax, without limit as to rate or amount, while all
164162 or part of the bonds are outstanding as required and in the manner
165163 provided by Sections 54.601 and 54.602, Water Code.
166164 Sec. 7910.203. BONDS FOR ROAD PROJECTS. At the time of
167165 issuance, the total principal amount of bonds or other obligations
168166 issued or incurred to finance road projects and payable from ad
169167 valorem taxes may not exceed one-fourth of the assessed value of the
170168 real property in the district.
171169 SECTION 2. The Harris County Municipal Utility District No.
172170 540 initially includes all the territory contained in the following
173171 area:
174172 TRACT 1
175173 BEING 159.65 acres of land situated in the H. & T. C. R. R. Co.
176174 Survey, Section 47, Block 2, Abstract Number 440, Harris County,
177175 Texas, being all of that certain called 159.6531 acres conveyed to
178176 Cunningham Interests, II, Ltd by deed recorded under Harris County
179177 Clerk's File Number (H.C.C.F. No.) 20110175218, said 159.65 acre
180178 tract being more particularly described by metes and bounds as
181179 follows:
182180 BEGINNING at a MAG Nail with shiner stamped "COSTELLO" found
183181 for the Southeast corner of said 159.6531 acre tract and being in
184182 the pavement of Stockdick School Road (width unknown) also being in
185183 the centerline of Peek road (60-foot wide) as referenced in Volume
186184 996, Page 491 of the Harris County Deed Records;
187185 THENCE, S 87° 58' 23" W, a distance of 2,582.65 feet along
188186 said Stockdick Road to the Southwest corner of said 159.6531 acre
189187 tract;
190188 THENCE, along the lines common to said 159.6531 acre tract
191189 and the remainder of a called 160 acre tract described in Volume
192190 1494, Page 230 of the Harris County Deed Records the following two
193191 (2) courses and distances:
194192 N 04° 45' 03" W, a distance of 309.54 feet to a 5/8-inch
195193 iron rod with cap stamped "COSTELLO INC. RPLS 4416" found for
196194 an interior ell corner of said 159.6531 acre tract;
197195 S 88° 22' 39" W, a distance of 42.85 feet to the
198196 Northeast corner of a called 3.00 acre tract described and
199197 recorded under H.C.C.F. No. D978707 from which a found
200198 5/8-inch iron rod with cap stamped "COSTELLO INC. RPLS 4416"
201199 bears N 84° 28' W, 0.37 feet, also being the Southeast corner
202200 of a called 158.33 acre tract described and recorded under
203201 H.C.C.F. No. 20130266472;
204202 THENCE, N 02° 04' 00" W, a distance of 2,330.87 feet along the
205203 line common to said 158.33 acre tract and said 159.6531 acre tract
206204 to the northern corner common to said 159.6531 acre tract and said
207205 158.33 acre tract from which a found 5/8-inch iron rod with cap
208206 stamped "COSTELLO INC. RPLS 4416" bears S 89° 21' W, 3.45 feet also
209207 being the Southwest corner of a called 156.432 acre tract described
210208 and recorded under H.C.C.F. No. V829107;
211209 THENCE, N 87° 59' 16" E, a distance of 2,640.00 feet along the
212210 North line of said 159.6531 acre tract and the South lines of said
213211 156.432 acre tract and a called 9.7770 acre tract described and
214212 recorded under H.C.C.F. No. G578991to the Northeast corner of said
215213 159.6531 acre tract and the herein described tract from which a
216214 found Nail with shiner stamped "COSTELLO" bears N 82° 39' W, 3.01

218216 THENCE, S 02° 04' 00" E, a distance of 2,639.69 feet along and
219217 with the centerline of said Peek Road to the POINT OF BEGINNING and
220218 containing 159.65 acres of land. Bearing orientation is based on
221219 the Texas Coordinate System South Central Zone 4204, NAD83.

223221 BEING 247.03 acres of land situated in the George Spencer
224222 Survey, Abstract Number 1369 and the M. M. Willsey Survey, Abstract
225223 Number 1459 of the H. & T. C. R. R. Co. Survey, Block 2, Harris
226224 County, Texas, being all of that certain called 235.55 acres
227225 conveyed to Cunningham Interests, II, Ltd by deed recorded under
228226 Harris County Clerk's File Number (H.C.C.F. No.) 20120237422 and
229227 all of that certain called 11.526 acres conveyed to Cunningham
230228 Interests, II, Ltd by deed recorded under H.C.C.F. No. 20140170048,
231229 said 247.03 acre tract being more particularly described by metes
232230 and bounds as follows:
233231 BEGINNING at a 5/8-inch iron rod with aluminum Texas
234232 Department of Transportation (TxDot) cap found for the Southeast

241239 iron rod found for the Southeast corner of a called 17.00 acre tract

305303 West right-of-way line to the POINT OF BEGINNING and containing
306304 247.03 acres of land. Bearing orientation is based on the Texas
307305 Coordinate System South Central Zone 4204, NAD83.
308306 SECTION 3. (a) The legal notice of the intention to
309307 introduce this Act, setting forth the general substance of this
310308 Act, has been published as provided by law, and the notice and a
311309 copy of this Act have been furnished to all persons, agencies,
312310 officials, or entities to which they are required to be furnished
313311 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
314312 Government Code.
315313 (b) The governor, one of the required recipients, has
316314 submitted the notice and Act to the Texas Commission on
317315 Environmental Quality.
318316 (c) The Texas Commission on Environmental Quality has filed
319317 its recommendations relating to this Act with the governor, the
320318 lieutenant governor, and the speaker of the house of
321319 representatives within the required time.
322320 (d) All requirements of the constitution and laws of this
323321 state and the rules and procedures of the legislature with respect
324322 to the notice, introduction, and passage of this Act are fulfilled
325323 and accomplished.
326324 SECTION 4. (a) If this Act does not receive a two-thirds
327325 vote of all the members elected to each house, Subchapter C, Chapter
328326 7910, Special District Local Laws Code, as added by Section 1 of
329327 this Act, is amended by adding Section 7910.106 to read as follows:
330328 Sec. 7910.106. NO EMINENT DOMAIN POWER. The district may
331329 not exercise the power of eminent domain.
332330 (b) This section is not intended to be an expression of a
333331 legislative interpretation of the requirements of Section 17(c),
334332 Article I, Texas Constitution.
335333 SECTION 5. This Act takes effect immediately if it receives
336334 a vote of two-thirds of all the members elected to each house, as
337335 provided by Section 39, Article III, Texas Constitution. If this
338336 Act does not receive the vote necessary for immediate effect, this
339337 Act takes effect September 1, 2015.
