| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 64.032, Election Code, is amended by | |
| 11 | 11 | adding Subsection (c-1) and amending Subsection (d) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (c-1) The person selected under Subsection (c) must also be | |
| 14 | 14 | a registered voter of the county in which the election is being | |
| 15 | 15 | held. | |
| 16 | 16 | (d) If assistance is provided by a person of the voter's | |
| 17 | 17 | choice, the person shall provide a photo identification to an | |
| 18 | 18 | election officer and the officer shall enter the person's name and | |
| 19 | 19 | address on the poll list beside the voter's name. | |
| 20 | 20 | SECTION 2. Subchapter B, Chapter 64, Election Code, is | |
| 21 | 21 | amended by adding Section 64.0325 to read as follows: | |
| 22 | 22 | Sec. 64.0325. UNSOLICITED OFFER OF ASSISTANCE. (a) A | |
| 23 | 23 | person who is not an election officer commits an offense if: | |
| 24 | 24 | (1) the person offers to assist a voter under Section | |
| 25 | 25 | 64.032; and | |
| 26 | 26 | (2) before developing the intent to make the offer of | |
| 27 | 27 | assistance, the voter was not known to the person. | |
| 28 | 28 | (b) An offense under this section is a Class C misdemeanor. | |
| 29 | 29 | SECTION 3. This Act takes effect September 1, 2015. |
