55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to limiting the amount of assistance a person may provide a
88 voter; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 64.032, Election Code, is amended by
1111 adding Subsection (c-1) and amending Subsection (d) to read as
1212 follows:
1313 (c-1) The person selected under Subsection (c) must also be
1414 a registered voter of the county in which the election is being
1515 held.
1616 (d) If assistance is provided by a person of the voter's
1717 choice, the person shall provide a photo identification to an
1818 election officer and the officer shall enter the person's name and
1919 address on the poll list beside the voter's name.
2020 SECTION 2. Subchapter B, Chapter 64, Election Code, is
2121 amended by adding Section 64.0325 to read as follows:
2222 Sec. 64.0325. UNSOLICITED OFFER OF ASSISTANCE. (a) A
2323 person who is not an election officer commits an offense if:
2424 (1) the person offers to assist a voter under Section
2525 64.032; and
2626 (2) before developing the intent to make the offer of
2727 assistance, the voter was not known to the person.
2828 (b) An offense under this section is a Class C misdemeanor.
2929 SECTION 3. This Act takes effect September 1, 2015.
