| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1601.004, Insurance Code, is amended by |
|---|
| 10 | 10 | | adding Subsections (c) and (d) to read as follows: |
|---|
| 11 | 11 | | (c) Notwithstanding Subsection (b)(2), "spouse" means: |
|---|
| 12 | 12 | | (1) a husband or wife; or |
|---|
| 13 | 13 | | (2) a member of a civil union or similar relationship |
|---|
| 14 | 14 | | that is entered into in this state or another state and is between |
|---|
| 15 | 15 | | individuals of the same sex. |
|---|
| 16 | 16 | | (d) Subsection (c) takes effect only if the United States |
|---|
| 17 | 17 | | Supreme Court or other court of competent jurisdiction holds |
|---|
| 18 | 18 | | invalid, enjoins, or otherwise prevents enforcement of any law in |
|---|
| 19 | 19 | | this state that prohibits: |
|---|
| 20 | 20 | | (1) the marriage of individuals of the same sex; or |
|---|
| 21 | 21 | | (2) the recognition of a civil union or similar |
|---|
| 22 | 22 | | relationship entered into in another state between individuals of |
|---|
| 23 | 23 | | the same sex. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2015. |
