44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to relating to the definition of a dependent for health
77 benefit plans offered by certain university systems.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1601.004, Insurance Code, is amended by
1010 adding Subsections (c) and (d) to read as follows:
1111 (c) Notwithstanding Subsection (b)(2), "spouse" means:
1212 (1) a husband or wife; or
1313 (2) a member of a civil union or similar relationship
1414 that is entered into in this state or another state and is between
1515 individuals of the same sex.
1616 (d) Subsection (c) takes effect only if the United States
1717 Supreme Court or other court of competent jurisdiction holds
1818 invalid, enjoins, or otherwise prevents enforcement of any law in
1919 this state that prohibits:
2020 (1) the marriage of individuals of the same sex; or
2121 (2) the recognition of a civil union or similar
2222 relationship entered into in another state between individuals of
2323 the same sex.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2015.
